Transfer L1A --> H1 (Need Advice)

Hi Folks,

I currently work for Company A on a L1A Visa from the UK, which is valid until May 2008. Company B has offered me a position (verbally) which I need in writing to move forward.

What I am not sure on is now is my visa affected. I assume Company B needs to apply for a H1B visa (as per reading our posts on this forum). Is that true? Now long does it take to receive a H1B if Company B applied for me?

Also, if I joined Company B on a H1B, can I apply for a Green Card?

Would my future GC app be affected by moving from L1A (Company A) to H1B (Company B)?

YOu need to apply for H1B, but problem is you can not file for H1 at this moment. The earliest you can file H1B is April 1 2007, and the earliest you can start working is Oct 1 2007. So, til then you can not work at B, unfortunately.

you can file for GC any time as long as sponsor is willing to do that.
Does not matter you were on L1 or H1.

My current company (Company A) is willing to sponsor me on the GC, so that's my only option. Once I get the GC, then I will review opps with Company B.

How long is the time-frame to secure a GC these days (with premium processing)? I was born in Zambia (Africa), but got my L1A from the UK, as I am a UK citizen.

It depends on your job category. Since you have L1A, you may be put in EB1C, and then it will take 5 months to years(The case it takes years is in case you got stuck in security check, otherwise a few months).
