My brother-in-law is in a unusual position. He is in India currently. He was offered a job by a consulting company in US, & his H1B petition was approved. However, during the visa interview at the US consulate, his application was put in pending category, as they had to do some background check for the employer. They mentioned there is nothing from his side that is missing, & returned his DD and 221(g) stating that consulte will notify him once processing was complete. It's been over 3 months since, & the consulate haven't got back to him.
Now since his H1B petition was approved, is it possible for another company to sponsor him & transfer the approved H1B petition to the new company? This is because the H1B quota is finished for the year, & if another company sponsors for a new H1B, he has to wait until October 2007 before he can get the visa.
