Transfer H1-B instantly after approval

Hi,

I have a case to discuss:

A company applied for my H1-B visa and it is approved as of last week. But due to some circumstances, I am not able to work with that company. I have joined a company in India and they are planning me to send on-site for 3 months for project which would work out for me based on my current situation.

I would like to know if it is possible to transfer the H1-B visa which was just approved to another company?

I have completed a MS degree in USA and my currently approved H1-B was from the Masters quota. If by any chance, the H1-B is canceled by the company through which it was approved, will I still be able to apply for another H1-B through the Masters degree quota?

Also, any other options for my situation mentioned above would be sincerely and highly appreciated. Thanks a lot!

---- US employer filed H1 for you and you are in India at this time and you did not post if US employer has sent you job offer letter and H1 approval notice for Visa stamping.

I would like to know if it is possible to transfer the H1-B visa which was just approved to another company?
------- H1 transfer can be filed by new if you are in US on valid H1 B status in US.

The US employer has sent me an offer letter and has sent me a case number. I am still keeping it on hold since I don't want to work with that company now. Should I ask them to send the H1-B approval so that I can transfer it?

As you have mentioned, new employer can file for fresh H1-B in future however, my concern was that would my case still come under that Masters quota for the H1-B filing?

----- don't inform him that you don't want to join him if you tell him your intention then employer will not send you H1 approval notice. Request him to send you the H1 approval notice as it is needed for H1 Visa stamping. once you get H1 approval notice then it is up to you to go for Visa stamping or not to . H1 approval notice or Copy of H1 approval will help your new employer to file Fresh H1.

----------------------You will not be subject to Cap as H1 for you was approved but your new employer will need the Copy of your H1 Approval notice.
