Hasan, My (ex)company\'s lawyer\'s (top 5 law firms in Washington D.C., charged $10,800 to my company for H-1 + GC) filed my NIW I-140 and I-485. I have seen their work and am very postive that they are very, very good at it. So, I don\'t think my petiton falls under that category.
As I mentioned earlier, mine is an employer petitioned NIW application and I changed (got laid-off) the employer after filing the I-485. For the employment letter RFE I provided the new employment letter. As per the law, NIW petitions, whether self or employer petitioned, are portable as long as you are in the SAME FIELD. Some of our friend\'s on this forum don\'t agree with this, but believe me, I have spent close to $1,200 in consultation: all the three famous lawyer\'s in this area and two from west coast stated the same...... By the grace of GOD, I am in the SAME FIELD as of today....so, I should be okay, but still have that tension.....
The IIO at VSC couldn\'t make a decision on the change of employment aspect and could not (no patience and time probably) research further....so transferred my case to the local INS. Thank you so much for your help. Happy Holidays....
