Training Day in INS

I came to US on J-1 visa without 2 years requirement (Work and Travel).
Changed my status on B-2 after 4 months and got the approval notice. After that I applied for H1-B and it was approved. I worked on my H1-b status for 3 months and then I got married to US citizen and moved to another state where I filed my AOS package.
I sent all the paper work to Hartford Sub office on Jan 14, 2004. I got my EAD and AP in a few weeks and my interview thereafter was scheduled on Jan 4, 2005 in Hartford Sub Office. We brought all the documents to prove our bona fide marriage, but forgot the tax returns for last year. The officer asked us to send it by mail and we mailed the additional papers in a couple of weeks. I didn’t get my conditional green card after the interview or by mail. A few months later we moved to NY and transferred the case to NYC office in June 2005. I received a notice that the case was transferred. They called us for a second interview that was scheduled on March 9, 2006 at 9am.
We got there earlier and we were surprised because no one was in the waiting room except the clerks at the counter. Clerks were surprised also that we came for an AOS interview and they told us that this is probably a mistake because they had a TRAINING DAY. They called the officer who was suppose to interview us and asked to wait.
They called us three hours later. The officer introduced us to the trainee and asked if we don‘t mind if the trainee will be in the room while he will be interviewing us. We didn’t mind.
He asked the formal questions, have I ever been arrested, on what status I came, where we met etc. We showed all the paper work: lease, credit card statement, joint account statements, utility bills, insurance cards, pictures, letters from employers, pay stubs, etc
Then he asked us to show the keys from the apartment, and after that he started asking more question. (we had the same keys including the key from mailbox.)
They asked me to leave the room and they were pushing on my husband to admit that our marriage is fake and I only want to get green card through marriage with him. That I know what I’m doing and right after I receive my green card I will leave him (my husband told that me later – after the interview was over). They told him that if he will admit that – they gonna deport me right from this room. He was in the room with them for 2 hours. The interview was for 5 hours
They called me and said that they can not approve this case at this moment and we will receive a decision by mail. He wrote in my passport I-485 is pending. A#. DAO his last name and date. :(
It was 3 months on June 9, 2006 and so far we didn’t receive anything.
I called the USCIS 800 number and they asked me to provide all the information to submit the form about the status of my case over the phone. It was more then 30 days ago but the customer service representative told me that I should receive a letter on my request within 30 days.
I don’t have an attorney because I can’t afford to pay thousands of dollars for their services.
Today I contacted the congressman Carolyn B. Maloney I sent a fax requesting to find out about the status of my case. THey called me back less then 24 hours and said that it will take a couple of days and then they will contact me.

I feel bad that you got stuck in the training day of the INS as they just used you guys to show the new people all the tricks they have for the interview.

Try an Infopass and go meet the immigration officer and ask for a stamp on your passport if you petition has been approved.
 
I scheduled an Info Pass for this Friday. Will see if I 'll be able to speak with the officer.
Do you think they can tell me in person if my case was approved or still pending?
I'm planning to go on vacation to Canada for 4 days. I have AP and my I-94 is still valid till October, 2007. Do you think it's risky in my case?

Yes , they will tell you in person if it is approved or pending. If they tell you it's pending then ask them why. As for the travel, as long as you have the AP you are ok. However, if you have overstayed your visa then it is risky. But in your case I dont think you have anything to worry about.
 
I never been out of status and I use AP a few times before.
I'm afraid that if i leave the country and they will deny my petition for some reasons.
You may expect anything from them :confused:
 
Dont worry about them denying your petition if they wanted to they would have done so after your first interview.

Sue them. You don't need a lawyer for that.

I feel sorry , and I hope things work out for you . Please keep us posted . The Interview should have been recorded , you could sue them for discrmination too .

You have 2 Senators and 1 Congressperson. Your husband, the USC who will vote (or not ;) ) for them, should contact them all, tell the whole story, complain about IO's behavior, make a lot of noise...you shouldn't be intimidated by his bully attitude, and lets put it this way: if a miserable IO will deny your case, that's not the end of the world, you can appeal, or take them to the court...
...Sixteen years ago, due to an old idiot IO woman, long time passed over the menopause, I got an intention to deny note from INS...and not knowing better at that time...took me 8.5 years to get my green card...today, I see things differently, I wouldn't mind to grab the IO by the collar and tell him to do his job the right way, if I have to.

I have one more question - In my passport it says :
first 3 letters I can't read - then 245 I-485 Pending @ NYC
MY a# . Date. DAO (last name) His signature.
I know what I-485 means but what is 245 code refers to?

CFR 245..this is the section of law under Code of Federal regulation that gives you the right to green card when petitioned by a USC.

WHen you croos a canadian border, do they take you to the "special" room?
I'm planning to use AP .
I have I-94 valid till october, 2006. I know that if you cross canadian border with valid I-94 and your visit is no longer then 30 days - you just show them your passport with valid I-94 on the way back. Is it true?
I know that I need a visa still :eek:
 
I went to Federal Plaza today with the info pass letter.
First they sent me on 3th fl and the representative told me that my case is pending, then she sent me on 8th fl - and in their database my case is pending too :(
And she dosn't know the reason. Once again she asked me to submit that green form to enquire about the status of my case and told me to wait a decision or respond by mail.
3 hours - no results.
Why it is still pending - who knows.

I am so sorry for all the stress that Ins is putting you through,it seems that your interviewing officer was a brute and they were headhunting at your interview.Hold on and be strong they have no reason to deny you permanent residency .I think that they just enjoy seeing us nervous and making us suffer to get residency .

Because that stupid IO had a problem with you.

Like I've said before, take action. Tell your husband to start contacting your Senators, Congressperson, etc.

Just waiting is not going to do any good for you.
 
I contacted the Carolyn B. Maloney, our representative. I sent them a fax - they called me back next day and a woman on the phone said that they will contact me as soon as they find out whats the reason for delay.
Didn't hear anything back so far :mad:
What else do you think I can do?
