Traffic Citations in N-400

All,

Am I suppose to disclose traffic tickets on my N-400? In the last 10 years, I must have received 6-7 tickets, mostly parking related. I was caught for speeding in 2001. I have paid all the tickets, but I dont have copies of the tickets and it will be too difficult to go through my bank statements to find a proof of payment. I have never been arrested or detained by any law officer.

My questions are as under:

1. Am I supposed to disclose these tickets?
2. Waht evidence can I provide?
3. Is New York DMV record adequate? What if one of my speeding tickets was outside of New York?

Thank you.

1. Am I supposed to disclose these tickets? YES
2. Waht evidence can I provide? NO EVIDENCE IS REQUIRED FOR TICKETS UNDER $500.
3. Is New York DMV record adequate? What if one of my speeding tickets was outside of New York?NO EVIDENCE IS REQUIRED FOR TICKETS UNDER $500. FOR TICKETS OVER $500 YOU WILL HAVE TO PROVIDE PROOF THAT THE TICKET WAS PAID.

Thanks nkm-oct23

One more question. I don't have details of the tickets. In that cae, what information can I disclose? From where can I get information of the tickets I have received? None of my tickets were over $ 500.

Before you freak out and drop to the floor, please relax a bit and query and read the posts -including the sticky posts.

This has been addressed on this forum ad nauseam. The answer is no.

If you still want to go chase proof of parking tickets and speeding tickets and all pure traffic related tickets under $500 -excluding stuff like DUI, leaving the scene of an accident, or any other quasi felony- go knock yourself out. Still freaked out? You don't deserve the paper the N400 is printed on. Read, stop, think, stop, think again, then act (and freak out if you have to).

There is a debate between members of this forum on whether traffic tickets should be disclosed or not. Please check the STICKY posts at the top of this specific forum (US citizenship). While there are variations at both ends of the spectrum, the general observation is that a ticket here or there does not harm your case (whether disclosed or not), but a pattern of repeated tickets is not good.

#1. I do not think parking tickets come under the umbrella of detained, arrested, but may technically come under cited.
#2. Under 500 does not require proof of payment (but the IO may have data to counter you if you say you took care of it but did not).
#3. Depending on the IO, or your situation, the IO might ask you to get closure information on these tickets. Depending on how hard it would be get this information, you can do it before the interview, or after the interview (if IO holds the case pending this). If you have only one ticket worth discussing, the chances are high that IO will not hold it against you.

This is one thing I don't understand. The naturalization guide says unless it is DUI or fine more than $ 500/-, no DOCUMENTATION is necessary. So most of us thought we still need to disclose speeding tickets without enclosing any documentation. But once we disclose a speeding ticket which is not DUI nor fine more than $500/-, they send this check list asking us to bring court letters to prove we paid it. Doesn't it violate the naturalization guidelines then? The book says no documentation and the check list says documentation please. So, that begs the question, is it a must to disclose minor speeding violations? So I am thinking now, may be it is not necessary to disclose them even though I did it at that time.

Good point Spiderman, I agree.

Thanks All - On the Naturalization Guide - in two separate places they state :

"Even if you have committed a minor crime, USCIS may deny your application if you do not tell the USCIS officer about the incident. Note that unless a traffic incident was alcohol or drug related, you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine less than $500 and/or points on your driver’s license."

"If you have been arrested or convicted of a crime, you must send a certified copy of the arrest report, court disposition, sentencing, and any other relevant documents, including any countervailing evidence concerning
the circumstances of your arrest and/or conviction that you would like USCIS to consider. Note that unless a traffic incident was alcohol or drug related, you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine of less than
$500 and/or points on your driver’s license."

So I am not going to disclose my parking / speeding tickets.

Don't worry about disclosing speeding tix that was fined less than $500 and not DUI related. And definitely don't disclose parking tix - it's so not relevant to N400 application.
