Traditional Labor (in process) vs. PERM opportunity with new employer

Hello all,
Following is my issue.

Background:
I started working straight out of school for my current employer. I have MS degree from US.
My Traditional labor (EB2) was filed in March 2005. My employer did not want to apply via PERM because they felt the on job training may be an issue with PERM.

Question:
1) Is there really a big difference in interpretation of rule for ON JOB TRAINING (Traditional vs PERM)?

Now I have an opportunity with another employer.
Should I jump jobs because ON JOB TRAINING may not be an issue?

Can you guys give any suggestions. I am worried about inexperience of lawyers filling PERM.

Has anyone got PERM approved yet?

thanks a lot for any and all suggestions.

I have a simple question for u. so u r saying in ur application in the pre PERM system, u applied with MS+0yr expereince? r u an engineer or what? is ur wage higher than level 2 in the old system? or lower than level 2 PW?

On the job training vs experience

Since you may have a hard time using your experience with your current employer (unless it passes the 50% rule), you actually be better off changing employer. Doing so, the new employer can add the years of experience you gained from your current employer to their PERM application, mwaning that on-the-job training may not be needed, but experience is needed instead. It's mpretty bizarre, but unless your PERM application and job is more than 50% different that what job you were hired for, your experience will not count, but changing employer, your experience from the previous employer will count.

NO my prePERM labor was filed with MS with 4 years experience. my lawyer said that from on title of job to another title of job it can be shown that the responisbilities are different.

I am not an engineer. I have MS in Healthcare Sciences and work for business improvement for HMOs.

I dont kow what level 2 salary is but my pre labor was file with salary of 65K-70K per year. Can you tell me what is the level 2 salary threshold?

Are there salary thresholds in the PERM process? because i need to make sure i meet the criterion with my new employer.

by how much is your wage lower than level 2?if it is 5 % less than the level 2 wage u r fine. otherwise ur employer has to change ur wage later. it is a problem that I'm facing this is why i asked u about ur wage. I don't know what to do.
