I-140

Hi Naanshi,

No update yet on the BCIS tracker, still says 150-180 days for mailing out decision.

However on September 23, 2003 I have filed I-485, EAD & AP.

Still have not recieved LIN numbers for them. Will update as soon as I recieve them.

I have been following these forums from long time. They are very helpful. U guys are going great job in maintaining excel sheets.

My case got approved today

I140/I 485/I765/I130 RD : 08/04/2003
ND : 08/05/2003

I140 RFE ISSUED on 09/02/2003 (Company ability to pay)
RFE replied on 10/06/2003
I 140 approved on 10/09/2003

AP approved on 10/01/2003

EAD not approved Yet. I havent seen any case where AP approved before EAD.

IS it possible ??

Well EB3 is for skillde laborers applying for immigration and EB2 is skilled labourers with advanced degrees.

i wonder how you posted 86 posts on this website and are asking this now. Hm......

Has anyone noticed that EB3 concurrant seems to have taken the lead as of now. :)

they seemed to have skipped over two months and jumped right from jun middle to august beginning. maybe they got a new officer who has been added to this and got a bunch of august applications to work on.

This weeks spreadsheet. two new EB3 concurrant approvals for Aug begginning. everything else seems the usual stuff.

Processing details regarding backlogs and the number of cases received by the NSC Service center.

a. The number of case receipts is on an average of about 115,000 per month. On the whole the center has finished 70,000 cases in June, 104,000 in July and the center foresees 120,000 completions in August.

b. The center will be getting 14 new officers and will complete adjudications of the present 10,000 asylee adjustments. In providing additional staff there will be a decline in processing times.

c. The processing times at present are 60-90 days for I-129s. Majority of the I-140s are at 180 days, and a few I-140s moving at a longer processing times. Hence the center is targeting on I-140s depending on labor certifications. The center is concentrating on closing out the last of the 10,000 asylee adjustments, for I-485s and will then move them to the employment-based adjustments and refugee processing.

I believe the reason that we see some I-140 cases getting approved in less than 6 months is because of the above mentioned facts.

I-140 approved after 193 days.

EB3/RIR CP (cons. processing)

ND- 03/25/2003
AP- 10/08/2003

I have changed to I-485 considering the delay, please let me know if I can switch back to CP ??

LIN 03-207-5XXXX

I 140 approved on 10/07/2003
AP approved on 08/06/2003
EAD approved on 08/06/2003

I485 - pending :)

As far as my understanding goes, once INS receives your H!-B renewal, your HI-B is automatically renewed. It takes INS approximately 60-90 days to send you your new I-94.

Check with your lawyer.

I don't think you are out of status.

Do u think it was approved due to semi-concurrent. Seems to be firtst NON_CONCURRENT after a long gap

Yes i have seen that once The Non concurrent applicant applies for 485 their 140 is approved soon . The same happens with my case too ... The only reason i could see for that when u file your 485 u also file for EAD and AP ... and generally before approving EAD and AP they definitely check 140 .....and most likely that could be a reason for 140 approval . This is what i generally saw from feb to sep .

Thanks Chinj. I was following the forum and convinced my lawyer to file I-485, EAD & AP. The BCIS website says I-140 is approved. I informed my lawyer that I-140 is approved. He emails me saying that my LIN numbers have come over the weekend and he will be mailing them to me. So maybe because of I-485 filing that they might have been approved.

Infact Naanshi mentioned last week, that some decision would be coming. His prediction was really good.

I have benefited a lot from this forum. All the guys involved in maintaining this forum are doing a great job.
