Tracker for appeals/MTR

Same this with me case status got updated over weekend..
but it does not update my EAD case status or MOTIC status.
I am assuming they re-open my I-485 case again...as before updating this message it was showing different message and now it is showing one which they were showing before denial.
I may wait for couple of days and then talk to NSC.
 
140 appeal got denied with Sheila Danzigs edu eval

My 140 appeal got denied with Sheila Danzigs eductional evaluation...not to spoil somebody's hope...just updating my appeal status...there may be others who succeeded with her evaluation...I had a 3 yr degree from India..
with more than 12 years of experience.. and the application was for eb2...might be my bad luck...:(...but I have another app pending and waiting on it's status...worst case...well let's call it the best case...I will happily go back to my ever loving Motherland.. India.

The status of my 485 now reads..

"On May 29, 2004, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made"

Does this mean that they have reopened my case? Please let me know if anybody is into similar situation. I will be checking with my lawyer today.

sounds like good news.
 
not to disappoint you but, it does not mean they reopened ur case. my status was updated with fingerprinting blah blah blah after the appeal has been filed almost 1 yr back.... It's just that the fingerprinting dept updates the case with their info (more like procedures)........

Anybody has idea how long it take to reopen I-485 after applying for MOTIC.

My EAD expired and EAD renewal is denied so I don't have any EAD to continue work.
I talk to INS they said My status is valid till they make decision on MOTIC but I am not authorized to work as my EAd is expired..

they are not giving me any timeline to reopen the I-485 case or decision on MOTIC...

I saw your valuable comments on most of the cases..I need one as I my status is in limbo now don't know what to do...please help.....

Here are my case details.........

PD: - 06/03 India EB3
I-140 approved : - 07/04
I-485, EAD,AP RD:- 10/29/04
H1 6 year term expired on : - 02/05
EAD ap: - 01/20/05 valid till 01/20/06
EAD ap: - 10/28/05 valid till 10/28/06
I485 denied on 7/19/06 due to involve in unauthorized work period mention
02/05 to 10/05 .......It seems that they don't have my first ead in record...

EAD RD:- 08/09/06 deined as I-485 denied
MOTIC RD:- 10/16/06.....
waiting for I-485 to reopen.....

my questiont to you is...
as this case is denied due to error but still I am not authorized to work as My EAD is expired and no new EAD...

As I can't refile I-485..becuase of Retrogression can I file for H1B extension for 3 years baes on approved I140....
How can I start working again as we know that there is no time limit to take decsion on MOTIC.....
NSc is saying I am in valid status till MOTIC get some result..but can't work as EAD is expired...

I don't know what to do....stop working...(I have to do that asap)...
Can I file for EAd again based on MOTIC or H1 extension based on I-140 ...

please suggesst some options......

I am the only one who can work and my family is depend on me....
 
I noticed factual background on your case. You know - This is the USCIS Error but your attorney made the mistake while submitting evidences to RFE.

Is MOTIC applied in Time? Because 485 denied in JULY – I mean that you received 485 denials in September. Is CIS allow to appeal with this denial issued September date.

Please let me know.

My attorney applied MTR on 9/28/06 mentioing that we got denial notice on 9/16/06 and filed MOTIC on 10/16/06 within time frame of 30 days after receiving notice of denial.

but just I spoke with one more attorney and as per him, I am not in status and Pending MOTIC means not your are in valid status( which one cis office told me).
and as my application is denied on 7/19/06 so i don't have much time...
and he is saying that only one option is there to file law suite against USCIS...

which will expedite process....

I think you are right. I have not updated my current address on the 485 case. Do you think I should call INS and update my current address?
Because it doesn't make sense if the 485 is in denied status.

How long it take to get decision on MTR if it is with INS officer

Hi,
I come to know that My denied I-485 case with MOTIC is with imigration officer as of 10/31/06. My MOTIC RD is 10/16/06.

Anybody has idea how long it takes to make decision on MOTIC case if it is with Immigration officer.

Labor once again.

Hi all,
Just wanted everyone's opinion here.
My 2nd labor is pending in Dallas BEC which was filed in July 2004 (as a backup). My previously filed GC case has been denied because of 3 years degree issue (the original labor was filed incorrectly as 4 yrs by my lawyer)
The 2nd labor has Item No. 14 as : College - 3 years, Bachelors or Equivalent, Major field of Study - Computer Science or Engineering, 2 years experience.
Item number 15 reads - "A combination of education, training and experience may satify degree requirement"
The 45 day letter was received in August 2006.
Does any one see any issues here with labor approval or I140 approval?

I am in my 8th year H1.

I talk to NSC agent they told me that my case is with Immigration officer from 10/31/06 and he is reviewing it so I may hear decision in 3-4 weeks this is for MOTIC rd 10/16/06.

I initiate enquiry through Senator and he confirms that my denied I-485 and EAD with MTR is with immigration officer as of 10/30/06..

I talk to NSC agent and she told me that My MTR with denied I-485 and EAD is with one immigration officer from 10/28/06 and MOTIC with other immigration officer from 10/31/06 so I may get decision by end of this month..

Hope for best....as I expedite process contacting NSC agent and told them that my EAD is expired and need EAD to work..

guys any idea how long it takes or shoudl I wait till after USCIS reported dates after the date which mine was filed at. Mine 140 LIN** was filed 5th May,06 and USCIS is reporting May 8th and after

Any one is in similar situation ?
Any one before May5th with I140 pending at Nebraska ?

Hi All,

I haven't received any correspondence from BCIS on my refiled I140 yet(rd April 19th 2006). This was refiled using Sheila's evaluation. Looking at the NSC history I am pretty positive that my case will be denied. My original I140 appeal was denied back in April.

I also have my backup labor pending at DBEC (filed in july '04) for which 45 day letter was recd.

The issue is, for my 9th year extension my lawyer submitted receipt notice of refiled I140 as the basis for extension. If the refiled I140 gets denied then should I file an appeal for denied I140 and send its receipt notice OR should I send the copy of my pending labor as a supporting document?
