Tourist visa question

My brother is filling out the application for a tourist visa to come to my graduation. He said that in one field they ask the status of the person he's visiting and the options are: USC, PR or Student Visa. I am currently a 'pending status', what should he put there? Has anyone's relatives filed for a tourist visa lately?

It was the same with my parents who wanted to apply for tourist visa. Then I was on pending status and they were advised to wait ( if they can) until I became PR, it sounds better in the officer ears,avoiding eventually problems for my parents since I came with B1/B2 and never went back.

My 2 cents.
 
That's just not good :(
He can't really wait for me to become a PR since my graduation is in May. I really hope this is not a problem for him.
Should he use my maiden name or my married name in the application? All the supporting documents that he has are under my maiden name.

The invitation letter which we prepared for my parents contains my husband and my name as their daughter. We made like this, because my husband is the one who can support my parents while they are visiting us.
The supporting letter which you sent is just on your name?
 
I didn't send any invitation letter. I just asked my school to write a letter saying that I will be graduating this May. My parents got it no problem about a year ago without any invitation letter or anything (or course back then I was still single). My other brother got a visa to visit me no problem too like 3 years ago. Do you think I should write an invitation letter?
 
Did your parents end up applying for a tourist visa while you were as pending status? What was the outcome?

When I came here as a visitor they requested at the Embassy. I read again the site,is written that is good to have one, but is not compulsory. Every country is different as we know.

Actually,your letter from school is a kind of invitation. I am just telling you what I did in my case.

No, Payala, because wasn't so urgent, thet didn't apply. They will apply in this summer, now I am PR.
 
From Embassy site

"No applicant is required to present an Affidavit, or even a letter of invitation, but they can be helpful in adjudicating visa applications."

"If a consular officer believes that a visa applicant does not have enough funds to support himself while in the United States, he can refuse a visa application based on the idea that the applicant will become a burden on the United States government. Thus, an Affidavit of Support from an American citizen or legal permanent resident can help overcome this potential ineligibility."

To payala: Your status is Pending AOS and that is what you should write on your application. If you think pending AOS is not a widely used term, you could write Pending I-485. This is my best guess.
 
I went through that situation recently. My family got their visa okay. I filled out the daughter field with: F-1 adj. PR
Not what I wanted to wirte but the only a certain number of characters are allowed. I also included proof of my legal status in the country. My original F-1, proof that I was still in school, marriage certificate and copies of my NOA's
But since you were B-2 who never went back, I am not sure it would work the same way. Good luck!

I am already a PR, I don't think it's matter now how I came or not. Or maybe it will influence my parents tourist visa? :confused:

I am just a little worried I guess. The rest of my family got their visas no problem but that was before I got married. For my parents, they didn't even ask them to present any documents. I haven't seen the form that my brother is talking about but as I understood, I think he's given options to choose from, he probably has a field labeled 'other' though... I'll have to ask him.

I already emailed him a copy of my I-20 and a copy of my marriage certificate. I think I'm gonna write a letter of invitation from my husband and I, just in case.

When my dad applied for visitor visa (for my graduation also), he put down "F-1". And he got his visa easily. No invitation letter, the only thing they wanted was his income proof.

I think it just makes it confusing if you put something like pending PR and your family might end up getting trouble at the US embassy by being asked to clarify what status you're in.

What princesskate said made sense... about putting adjusting status or something, it worked for me, but I am not sure they took that into consideration. They really looked at proof of income and also my family was telling me that they got a copy of my passport or my visa and started looking something up on the computer. I am guessing they were looking at SEVIS, but that is just a wild guess.
As for my name, I used my married name. Since it was acompanied by my marriage certificate, I guess it was okay.
I really have no clue if they'd be able to find anythign about your AOS process on their computer. I did send a copy of my NOA's though, but my family said they didn't really look.
Also, I didn't write a letter of invitation, but some people do. Hope that helps!

Thanks so much! I think they are only gonna write F1 and hopefully, like with PricessKate, they won't even ask for anything related with the AOS process. My mom said that my brother will bring all the extra info in case the officer tells him that I'm not an F1 anymore since I applied for permanent residency. Plus he's gonna bring all the supporting documents (income, assets, etc).

OK I just wanted to update this post. My brother, his wife and son had their 'interview' on Monday, after waiting for a month. It wasn't really an interview since they almost didn't ask him anything. They just asked him if he was coming for my graduation, they asked for absolutely no proof. He had copies of everything, from my I-20 to my wedding certificate...nothing was needed. They all got their 5-year visas no problem.
Oh and we decided to put F1 as my status.
 
My parents, sister, aunt and cousin are going to come to the US for two weeks, for my official wedding reception in September. They can come here on the Visa Waiver, so I don't have to worry about visa applications.

But: does anyone know whether my family could have problems at the POE, when they are asked about me and my pending AOS status?

Any advice or comments greatly appreciated! :)
