Totally confused!

Today, I received a letter from NSC in response to my status check inquiry, stating that my case is not ready for a decision yet, as the required investigation into my background remains open. Is this an indication of pending security checks?

I'm a bit confused since the previous letter (dated Nov 8, 2006) states that security checks have cleared on my I-485.

Moreover, on Nov 16, 2006 I had an InfoPass appointment and the officer confirmed the same that security checks had been cleared and my case is ready for adjudication.

Any ideas what is going on?

Yes, I've already scheduled an InfoPass appointment... Hopefully, I'll get some answers. I'm also considering writing to a senator. Does anyone have any template for this purpose? Thanks.
 
I am on the same boat. I was stuck on Name Check for 1 1/2 yrs. My NC was supposed to have cleared last month based on the letter from FBI. I spoke to NSC rep last week. She told me that they received NC results and the fille will be reviewed by an officer soon.

I received a letter from USCIS today in response to my attorney's inquiry. It says that 'Processing of my case is deplayed as my backrgound checks remain open'

I don't know what this means if this means any.
 
I had an InfoPass appointment today and it was a total waste of time. The IO told me that he is not able to see if any security checks are pending. This is weird since when I had an InfoPass appointment the last time I was told the opposite. So do they have access to see this information or not?

When I had my infopass appointment in one of the local offices in Wisconsin last November, the representative told me that she could not see info on the security check in the system.

I think it depends on the IO. When I have infopass the I/O was very nice. She even turned the monitor towards me and show me the date when Name Check was requested. The date was 10/07/05. (what a day)

I also have AP Renewal application pending at that time. I asked her what are my option If have to go back home in emergency?

She showed me that someone is working on my case. There were 5 entries on that page and all those dates were off by 2 or 3 days when I notice the LUD on the web.

Me: But I have received conflicting letters from them already
IO: Don't call, write a letter
Me: And it is going to take another year for someone to read it
IO: On average it takes 1 year for that type of case
Me: How long does it take to clear a name check?
IO: I don't know, write a letter
Me: How long does it take to approve the case?
IO: Sometimes 2-3 years, here is your receipt number and the RD date (he writes it down and hands to me)

What is the purpose of InfoPass anyways?

Sue them! That's outrageous, i can feel your pain...

I totaly feel your pain too. Just reading about that infopass makes me mad. Those guys are totaly not accountable for what they say or do. And yet we keep paying taxes to support them :rolleyes:

The whole process is very humiliating. If I was aware of how inneficient this process is when I came in 2001 (went throuhg LC 3 times during these 6 years :rolleyes: ), seriously, I woudn't have come to the US at all. It is just not worth it.
But since we are already here and gone through all this crap lets gut it out little more.

In your case I'd sue them. You seem to have the case with those conflicting letter. The only thing is that most people here sugest WOM after 1 year. It should not be more then a few thousand for lawyer costs.

Security Check cleared

I had an info pass appointment in August 2006 and the IO told me that my security check is pending. I contacted my congressman and they enquired with USCIS and again told me the same thing.
Last friday I got a call from my congressman office and they told me that USCIS has called them and informed that my security checks are cleared.

How many months/days do you think we should wait before approaching the congresman office. I am also stuck in security check.

I have no idea how long to wait. I contacted Congressman office and they told me they will follow the case but they can't expedite the security check. Then I took infopass appointment to know about my security check and then suddenly I got call from my congressman office that my security check is cleared.

It depends who you talk to. I have scheduled an another appointment. I'm going to keep scheduling InfoPasses until I get my answers.
 
Name check cleared?

Today, I had another InfoPass appointment and the officer confirmed that all security checks have cleared on... 05/09/2006. I even specifically asked for the FBI name check. This proves that InfoPass IOs CAN access this information. I still don't understand why I get such a response from NSC saying that "investigation into my backround remains open"? Is this something different than a name check? I asked the attorney to request to expedite.
