todays interview experience for N400 & I751

Hello all

I would like to share my expenience for my I751- and N400 Interview.
Before my experience I wants to shere my history of cases. I was going through very hard time since my i751 was pending sice from 18 months and then i filled n-400 on december 2008 my n400 interview date came but i751 was still pending in the meanwhile, my wife seprated from me about few weeks ago,
I went to diffrent attornys for advice wat should i do? (becuse my wife didnt wants to corprate with me and also she filled divorse) i went to three diffrent attornys two advice me that I should go for my n400 intervew with or without my wife but one told me that dont go by yourself becuse i751 was joint appliaction with your wife so you must take her with you, if she will not go with you your both appliaction in trouble but if i withdraw my n400 and file new i751 single then may have some chances for me. any how I decided to go for interview without her.
Interview was secheduled 8am i reached 0715 am, 11 am i was called for interview.lady officer was very nice.she went through with n400 appliaction was asking my all information on appliaction is true and nothing was change, when she ask me if my wife live in same address where i live, at that time i didnt lie and told her truth that now a days we are going through very hard time and some diffrences came between us so she is not @that address right now, then office ask me how long you been sepreted i told her about 4 to 5 weeks but we still in tuch and working on our relation.
then lady office ask me to sign my picture infront and ask me to sign on last paper on n400 appliaction i did.
after this she open another file was i751 and ask me all information on appliaction and ask me some more proof of marriage sice we married i show her my life insurence policy on my wife name and tenant agreements and lots of other bills and joint bank statments, she made photo copy of that papers and said to me that now she will take my civic test for n400.
she asked me 6 question was very easy i passed and then she ask me to write "the capitol is in washington .D.C."
she told me that i have passed my test, and finally she gave me a notice N-652 saying that at this time decision can not be made, but she told that i will get my oath latter by mail soon.maximum by 4 months. also she apologise for my i-751 delays.
now i am not sure wat will happen, but I have Faith on my God that good decision will come soon......................................

any body have any idea wat will happen next?

There are at least two possibilities:

- your case may be referred to a supervisory IO for a decision based on the special circumstances of your case. This could potentially add two to three weeks of time before a decision is made

- USCIS may want to complete processing the I-751 before they process your N-400 so that you would be processed for naturalization on the basis of being a 3-year LPR without conditions

Just a couple of possibilities - I am sure others may be able to provide perspectives as well.

Your N-400 application cannot be adjudicated until your I-751 is approved. In my opinion the most likely outcome is that I-751 will be approved but N-400 will be denied (for now). The bar for I-751 approval is much lower, basically just showing that your marriage was a valid bona fide one. However, in order for an N-400 to be approved based on a 3-year marriage to a U.S. citizen, you'd have to prove that the marriage is intact at the time of the interview. Obviously, that was not the case with you. So most likely (and in my opinion inevitably) your N-400 will be denied. However, if your I-751 is approved and you become an unconditional LPR, you'll be able to refile an N-400 in two years from now, under a 5 year rule.
I think that you should be much more worried about having your I-751 approved at this point. If your I-751 is denied, you lose your green card status and in fact any legal status in the U.S. Hopefully your I-751 will be approved. If it is denied, however, you will need to file a motion to reconsider very quickly and you'll certainly need a lawyer at that point.

Best case scenario is that they end up approving your I-751 since it's been pending since before you separated, but deny your N-400 since you have since separated.

The OP can't get approved based on 3 year rule if there is a break in marital union, which he indicated there was (spouse filed for separation).

I am still waiting for my latter from uscis, no any news yet!
I am going today to my local D/O for inquiary, Plz wish me Luck.

I have full trust on My Allah. ...... Good news will come soon.

I went to my local d/o 2day. I was told that my third file just arrived from other d/o so i will get my decision soon now. when i asked the IO that i have only two cases/files, what is third file/case ? then she said that third file is about your first entry/visa in usa.
Now i dont know why they are checking that record? and how long they take more? still not clear. But hopefuly very soon...............................

I call uscis today. 2nd level IO told me to wait more two weeks. If no answer then call them back.

Last week I went for info pass, and i was told that no decision has been made yet. and they dont know how long it takes more .............................
I am :confused: wat to do? sine two months of my interview but no decsion yet. I am planing to contact to my congressman.

any suggestion from any body plz?

I would wait until the 120 days are up and get another infopass. At that meeting say you will be launching a law suit since it is now beyond their statutory period. Ask to speak to a supervisor and see what the response is to that.

From cases I have read here, things suddenly got going quickly once USCIS received the first submission of intent to sue.

My concern is about my i-751 which is pending from 21 months and acording to IO( on my phone inquiary) may be my n-400 is on hold becuse my i-751 is still pending and they can not adjust n-400 until my i-751 approved.

plz pray for me all.

Your N-400 can't be adjudicated until your I-751 is. You may also want to contact the USCIS Ombudsman at this point to let them know your I-751 has been pending for so long.
