Merry Christmas to you two & all waiting souls.

A Freind of mine wants me to ask you two things:

His ND is April, 2000. He is main applicant. His wife & daughter all got GC in July, 2005. He has no news from INS at all though he was requested to do Code 1 in Nov.

Question 1. He was a main founder of a Democracy Party of China in 1988 which in the time of Tien An Men students moverment. He escaped into USA in 1999. As he applied political asylum, he gave INS all the details about that Pre-democracy party. His application was granted soon.
When he applied I-485, he filled up the form in the part of " Party section" as " Yes".

Do you think it will cause his delay in getting his G/C?

Question 2. When he was in China, he used a Alias to escape the Communist Party of China, he also fill up the form for all the documents to INS about his Alias, even this year's biographic information.

Do you think it will cause his delay in getting his G/C?


Please help this poor soul, he is taking anti-anxiety medicine daily. I saw him lost 30lbs in recent month as he has strong fear of of being sent back to China.

Tell your friend this: He has gotten political asylum in this country, he has already proved everything there was to prove, hence the grant of political asylum.

I am pretty sure all the information you say he wrote in his I-485 was also on his political asylum application..so its all ok.

He is approved, tell him to stop taking anti-anxiety medicine. The delay may be because of many reasons, maybe his name matched with somoene else's and is stuck in name check. Maybe the officer working on his case is busy with other cases...Maybe FBI hasn't returned his fingerprints.

I assure you this, gaining political asylum in this country is a very strong status. He should stop worrying. Just do as they ask and you will be ok.

I agree--tell him to relax and enjoy life. The bureaucracy is just taking its sweet time.

He got nothing require from INS, no interview, nothing at all. That makes him more worry.

His lawyer told him that if he put " Yes" to the section of any political organization, religious, army etc, even press & media. Then, he will be sent a special Office of FBI to check those Party's background, then he will be released back to common. Is it true?

Also. his lawyer told him according to INS working sheet, his case has been approved inside INS, but waiting for his background checking, then gives him the G/C. As his is main applicant, then from his approval base, INS issued his wife & daughter G/C. Is it true?

His lawyer is stupid. There are no "TWO" approvals. INS will not approve his case until his background is clear. They first clear everything about you and then look at your case. His daugther and wife's G/C is separate from his application. Yes he is related to them, the source of them being approved, however it doesn't matter if his GC is approved or not.

Immigration is looking if the benefit is available to a person before issuing them GCs. So in this case, the officer looked to see that if they truly were derivates to the main and there was proof that they were and the principal had his asylum approved...thats it. They do not care if his GC is approved. If he was applying for I-130(for spouse of GC holder), they will check if he has a GC.

Immigration wants to know if:
a)You friend is an asylee
b)Your friend is not a terrorist,
c)Your friend is not a criminal,
d) Your friend is healthy and won't become burden on U.S Govt,
e)Your application is consistent with what you wrote on your political asylum

So if he said "YES" to some question and Immigration thinks that it is cause for national security, they will ask your friend for an interview. If suppose you write "Yes I was a nazi, I loved it..heee haw"...Ofcourse immigraton will say Ok what do u mean by this statement..we cant give you an imigration benefit..blah blah..

As long as your friend didn't commit crimes against Human Rights...he is ok.

He is healthy,has PH Degree, he works two jobs a day, 7 days a week, annually more than one hundred thosand dollars income. He pays lots of Tax to federal government. last year, only to Federal government, he paid forty thosand dollas. his neigbour, a Chinese lady is only paying very income Tax, already got G/C. Restuarant waitress, stlylist of his friends( with low income) all got G/C. His ability is great, so he is complicated?

Education, paying taxes has nothing to do with ASYLEE Green card. If he applied through ExtraOrdinary ability visa..then yes but as asylee it doesn't matter.

In countries like germany, the more taxes you pay, the faster you become a citizen..not in this country.

Stop being ridiculous. Chill. Let the government do its job and they will get to his file!!!!!!!!!!! He is not the only person from 2000 who is still not approved yet, for God's sake.

Dear Atique:

Merry Christmas to you, too. In the begining of 2006, the first gift you will get is your G/C, definitely. Or rather you might get it before New Year's Eve.
