To stay or to leave the country?

Hi

I graduated this year and my ji expired on august 31.I have grace period of 30 days.
Then i am out of status.I have a job offer ,and will apply for waiver through state 30.Would it be better to leave the country till my h1b and waiver are approved?
Or can I stay here if I file my h1 before end of this month?Will it be a problem to come back even if i have approved h1b?

Go to the home country, life still goes on as you left it, or even batter! Pass the two years and broaden your choices. Apply for Canadian PR while its open.
 
Consider going home. Your waiver processing will easily take a couple of months. How far along are you at this point in time (case#, Dept of Health support, the actual waiver application)?

You don't want to run into trouble with excess out of status time while doing a change from one non-immigrant status into the other.

(There are some special rules regarding the J1-H1 transfer. As your I94 is typically stamped D/S, you are in somewhat better shape than people who have a finite expiration date on it.)
