Hi all, do you all think whose PD is after june/july 99 got their I140 approved for CP. IS this reason due to which our cases are delayed? Because i know some friends from the same company whose PD was Feb 99 & not CP cases got approved 15 days back even though they had applied after me. MY PD is Nov 99, RD july 24th, Nd Sep8th, FB Nov 27 still Avm says process resumed
 
Might be true

MY 140 is for CP as well -it\'s making sense.may be we need to wait few more weeks.
 
How to find out if 140 is for CP

Can you guys tell me how can one find wether 140 was filed for CP
 
look at your I140 Approvel notice.

If I140 approvel notice saying "We informed to national service center and further processing will be taken care by respective consulate". this kind of information you will find on your approvel.
I do not know CP makes difference for GC approvel duration or not.

yes it makes difference indeed. Since 140 is approved for CP I140 file would have beeb sent to your respective consulate( like chennai, Bombay)> when an officer opens your I485 files & comes to know that your I140 approved for CP he will request the respective center to send it. It takes some time to arrive at INS so your case will be delayed little comared to other people. What do u guys say, correct me if i iam wrong

In my case my I-140 was approved for CP and the file went to National Visa Centre (NVC). The NVC sends a letter to confirm if you are doing CP if yes then they send the file to respective CONSULATE else if you are doing AOS here in USA the NVC will keep the file with them and will send it back to INS when INS request it.

My I140 was approved for CP in Oct2000 and then NVC had sent the file to Consulate (not just a wire, I mean the actual file) in May 01. We recieved the Packet 3 some time in June. We just ignored the packet 3 and applied for AOS on 07/09. My ND is 08/23, FP 12/18 still waiting.
I even spoke with IIO and it was of no help. He did not give any info on the request for I140.
In essence, I think for some cases INS will not even request the file from consulate and they are lucky. Others just have to wait.
 
It makes sense. Mine is 140 CP ...

RD 7/23, and Process resumed on "Jan 14", but still waiting.
Whereas, July 30 is approved already.

Our company Attorney screwed our GC process.
Anyway, lets wait for our turn.
Also, my PD is june2000. I am not sure what affects the approval (whether 140cp or PD or State). God only knows :)

I-140 CP for me also.

How did our company did My I-140 in CP without telling us. Even after approval , and also while applying I-485 also they didn\'t informed us.

See how our company does the things. I am also suffering the same..

Mine was inadvertently sent for CP (the old I-140 evidently had an
ambiguous question that they\'ve now omitted). My sponsor
called--the file was at NVC, not in the British Consulate, and they
returned it back to VSC. From what I remember, the NVC is in
New Hampshire, so it probably doesn\'t take long.

I was told it would make no difference in processing time. It took
me two months to get my I-485 receipt (things appear to be
quicker now), but that seems standard for most Aug 2001 filers. I
would imagine if there was any delay, it would be between the
I-140 acceptance and the I-485 receipt (they have to have the file
to issue the receipt notice).

I immediately contacted my sponsor when I got the VSC letter
and we sorted it all out that week.

Maybe if you ignore the letter or respond with your agent\'s
address for correspondence, they send the file on for CP?
 
Yes, If you do not inform NVC that you are applying for AOS, Your file will land up

in a foreign consulate. Once this happens you are helpless but to wait more than your colleagues who applied with a normal I-140. My Rd : 08/07, ND : 09/27. I just dont know what will happen to my approval.

Also It\'s a good idea for us to keep in touch as we are all victims of 140-CP. Pls. post if you know any approvals with 140-cp. I know Bayofb got approved recently. It took him about one full year to get approval.
 
The old I-140 was unclear

There was a question on the old I-140 that asked something like
"if this case has to be processed outside the US, which
consulate do you want to process it?" Your sponsor had to give
some answer, and evidently this caused the INS problems as
cases intended for AOS ended up in CP.

The INS recognized the problem belatedly and changed the
form. It is probably not your employers\' fault (or your lawyer\'s if
you have one).

This happened to me. I was devastated, but it was all sorted out
remarkably fast. I think the main advice I have is to deal with
every letter from the INS as soon as you get it--even if it includes
not-so-great news.

peeps... atleast you aware that your 140 is approved for CP . But in all our cases this all happened without our knowledge. That too we recently came to know about it. For many of us they haven\'t given any I140 approval document & any related stuffs , they have nicely screwed us. So all the trouble is unfolding now... God knows when we all get out of this

anand-KV--I\'m so sorry this happened to you and the others. I
was sick when I found out.

I actually asked my sponsor (the University of Pittsburgh) why I
received the letter from NVC only by chance--I was actually more
interested in the EAD at the time. I had no idea what the letter
was about and Pitt\'s advisor was the person to tell me what
happened.

Yes, it is unclear. The advisor at Pitt (and I) even failed to notice
the small type on the approval notice about the case being filed
at NVC.

I hope we all get the GC soon.
