I am eligible to file for USC in about 6 months. Can I marry my domestic partner before I become a USC or should I wait till I become one? She would have overstayed over 180 days by the time I become a citizen. Any sound legal advice will be appreciated.
regarding marrying before or after becoming a USC, it doesn't really matter. what matters is when you petition/sponsor your husband/wife -- before or after becoming a USC. because that's when the processing time changes. i read somewhere that processing time for petition for a spouse by USC is faster than that for petitioned by an immigrant. The only issue I have is what to put on Part 8 of the N400 application for my wife's Immigration Status if I marry before I become a citizen. I guess I will need to say "B2 Visa - Out of Status" to be truthful. Will that harm my N400 application and/or could it trigger removal proceedings on her part before I become USC?
