Hi JoeF,
My GC approved on July 31st 2003 and still i'm working for the employer who sponsored my GC. Last week, Since I have GC, My employer paid me only 40 hours instead of 80 hours as they afraid that, i'll leave them any time. They gave me the reason that, my Client only paid partial payment. I have been working for the client for the past 4 years and i never had this issue. So, I am not sure, this is true or not.
But my question is, As a EMPLOYEE of my Company, they should pay me the salary whether the client pay them in time or not. I dont have any contract saying that i'll get paid only when client pays to my employer.
Is there any labour law saying.. the employee should get paid by employer even though the Client delays payment? Please give me more details with the section code etc..
I would like my employer know that, I aware of Labour law so that, he'll stop doing like this in future and I could inform dept of labour if he doesnt pay me in time.

Thanks in advance..

Thank you so much for your quick reply. actually I get paid twice a month. I work 40 hours per week. As you mentioned, I will consult a lawyer specializing in labor law.
Yesterday I talked with my Client and they always send a check to my employer in time. After hearing this issue, they offered me a permanent position with higher salary and to join on Jan 02 2004.. I'm not sure, i should take this offer as my GC got approved on July 31st 2003 ( only 5 months over as of Jan 02 2004). I'm sure, my employer will complain BCIS. He's really a blood sucking man.. I know, you are not a lawyer.. but please share with your thoughts whether I should take this offer or not..

thanks in advance.

sen485,

You seem to have a good case and good chance of landing this
new job.

However as JoeF has rightly said, initiate a dialogue with your
employer through email, asking why he is not paying the full
salary on time. This should lead to a paper trail which could
be useful in future.
