Since VSC is generating RFE for some the IGaters, I would like to
give you all a little insight how it was handle in my case.
1. RFE for Emp Letter was generated on 11/1/00. I do not know when
it was received by the attorney\'s office.
2. Reply to the RFE was sent to VSC on 11/13/00.
3. I received a copy of the covering letter that was sent to VSC from the
attorney\'s office on 11/17/00. This is when I came to know that there was
an RFE issued for me. Everything happened without my knowledge.
(Note : I guess LD contacts you only if they need any info from you. For
example, if the RFE asks for things like pay stubs, copy of W2 or tax
return etc..)
4. Called AVM on the same day. The message had changed to reflect
that reply to RFE has been received on 11/17/00.
5. My PD became current on 4/2/01. Spoke to IIO on 4/19/01. I was told
that my case was looked at in 12/00 and it was not adjudicated since my
PD was not current. She also told me that my case was with an Officer
since 4/2/01(the day PD became current) and I can expect the approval
any time.
6. Nothing happened for a month. Spoke to IIO on 5/18/01 again. She
told me that my case was PENDING. When I asked her what does that
mean, she said it is back in the shelf and it is done when the officer
thinks that someone else should take a look at the case. I asked her if
she has any idea, how long should it take? She asked me to call them
only after three months.
7. I realized that this had happened because my Amd 140 was filed on
4/13/01. The officer had noticed it and put the file back on the shelf.
8. I got my Amd 140 approved on 6/8/01 and I485 was approved on
6/20/01.
