We have prepared everything for our filing of I140/485.
However, ETA750 Part B of my approved LC has some errors
regarding my employment history (time and employer).
My job requires 1-year experience.
My lawyer thinks that it's not a big deal but he corrected
the errors and requested a
re-stamp of my LC with DOL (DOL agreed to do that before submmitting).
We have been waiting for the re-stamp for
a month and no answers so far.
My questions are:
1. What does the approved LC paper look like? Is it a separate
piece of document, or just the ETA form (application form for LC)
with DOL stamp saying it's certified? If it is a separate paper, is
ETA form still required to be submitted with I140/485 concurrent filings?
2. I prefer filing our I140/485 with BCIS first while waiting for DOL
re-stamp, instead of waiting until re-stamp is done, since I have no idea
how long will this take. And BCIS will not look into our case within 10
months anyway. We may submit restamp at a later time, is this OK? But if
LC paper is just ETA form with stamp, will we have trouble if the experience
listed is a little bit mismatch with all other documents?
3. Anyone knows how long will it take for DOL to re-stamp a corrected ETA form?
( preferrably Atlanta DOL or GA DOL)
Any suggestions or comments? Please post.
