You seem to be very good in predicting approval/denial/RFE based on LUD changes. I understand that it is different for each and every case. But based on the pattern you had been observing with LUD changes, what can you say about my case (140)?

My 140/485 filed on 10/17/03 and did 1st FP on 9/25/04, there was absolutely NO change in LUD/online mesg after FP.

Recently my employer faxed a letter to VSC regarding my 140. VSC replied back saying that my CASES are currently being processed and i should hear from them soon. Next day i saw LUD change on my 140 on 12/3 (friday) and again on 12/6 (Monday) with no change in mesg.

I'm guessing they might have denied my case as it was a substitute labor case. I checked with my attorney if they have received any letter from CIS.
sO FAR they have not received anything.

I would appreciate if you share your experience with us. Thanks in advance.

RFE for I-140 submitted on 1st Dec.
uscis received it on 6th dec
Msg updated on 6th Dec.

LUD has changed on 7th dec, 8thdec, 9thdec, 10th dec.
No change in msg.

Where am i heading with all these LUD updates ??
Y so many LUD updates(4) with no updates in the msg. ???

I dont think that LUD change can be assumed to be a denial. I think since you did an inquiry, your LUD changed. Usually if you do inquiry, they will access your file in the system to check the status of your case. This would trigger a LUD. Also I have observed that there are always two times the update done on your case when the file is accessed. Sometimes the first update will be late in the night and the other is early in the morning.

I can only come up with two different theories why that would happen:

1. The first update is when the advisor "checks" out your file. The second update is when the "check in" your file back in the system. Sometimes this action will be done in the same day and you will see one LUD. (There are actually two LUDs but since they are on the same day you dont see it). Sometime they will do one late in the evening and the other next morning and you will see two LUDs.

2. The other theory I can think about is that there is a batch process running between their online system and the actual system they use. The batch updates everything two times (to prevent errors). Depending on when these two updates are done, you may see either one LUD or two LUDs. Though this theory is weak :)

Whatever, I dont think it is correct to assume that you will get a denial.

I think they are working on your cases. The list of cases that I track in a portfolio, I have seen that they approve a case from 1 week to 3 weeks after receiving the RFE response. There are usually 2-3 LUD updates after RFE received and approval. I think you are heading towards approval soon.

can you let me know the fax number of USCIS, since my response to RFE is more than one month old and i don't see any changes in LUD, after they acknowledged it. Thanks

So you think they checked in my file back into the system without any response ????? :) thats so strange..

Generally for the approval, how many times LUD change in common?

I got VSC fax no from this forum only. I have it saved on my work PC, i could give you that first thing on monday morning.
