I\'ve been waiting to post this for a long time, and with the help of a Senator, it finally came true today!

I\'m probably the only one left here with a ND of 9/98. Two weeks ago I posted that I was contacting a Senator in my state to inquire on my case. The Senator\'s office did just that and told me (in two days) that the reason my case hasn\'t been approved was because it was "misrouted". They told me to expected a notice in a week or so, and to contact them again if I didn\'t hear anything in two weeks. Today is exactly two weeks since they sent me the letter. I called the automated message system and heard that my case has been approved. I was terrified that I would get RFE or FP redo (I did my FP in 3/99). This is the best news I can expect!

I want to let people know that it *can* be helpful to contact a Senator or Congressman if your case is very old, and if you carefully choose the person to seek assistance from. I\'ve been asking my useless lawyer to talk to INS and inquire on why my very old case hasn\'t been approved, they refused to and told me to just wait. If I had listened to them I\'m 100% sure that I\'ll still be waiting today.

The total time from labor took 2 years and 9 months (PD=11/97). It has been a very frightening and agonizing wait in the past year due to major reorganization in my company, and also the fact that I really want to move on with my life.

I\'m still waiting for the approval notice to arrive. I want to thank everyone who\'s been in the same boat with me and sharing stories. This is a big part of how I managed not to go crazy in the past year.

Congratulations! I am very happy for you! I know exactly how you would have felt because my ND was 11/98 and I was freaking out to see 7/99 approvals when I hadn\'t even got a RFE. My case got approved 7/26 and I got my PP stamped yesterday at Newark.

Yes, I did get a RFE for "Current Employment Letter". RFE date: 6/17/00, RFE response received: 6/30/00. I did contact the Congressman about three months ago, but I don\'t think that helped because at the time the I485 processing was at a standstill.

I don\'t think you should contact your senator/congressman if other people with your NDs are NOT been approved either, because you would not be an "exception" and senator/congressman can not ask INS to approve your case when other people with similiar NDs are not approved. But they can make a case if just about everyone else with same NDs are approved except yours. I thought my case was perfect for contacting senator/congressman because it was soooo old (9/98) and VSC has publicly claiming to be approving cases with 4/99 NDs. I also think that it\'s a bad idea to contact more than one senator/congressman. Choose one and stick with the same one unless it\'s obvious that that one is not doing anything for you.

For anyone who\'s considering contacting a senator/congressman, here are the details of what I did:

1. I went to the websites of all of our senators and congressman and picked the one that I thought seemed most sincere. On the website of the senator I contacted they actually had "help dealing with federal agencies" as one of the services they provide to residents.
2. I called the office and asked what I would need to do to request assistance for dealing with a federal agency. They told me that they need a letter with my signature on it in order to inquire on my case because of privacy laws.
3. I prepared the letter very carefully, emphasizing the point that my case was very old, VSC was claiming to be approving much newer cases, I\'ve contacted VSC about it but they didn\'t do anything so I felt helpless and that I had no choice but to seek congressional assistance. I also quickly gave a history (just one paragraph) of my labor and I-140 just so they have an idea of the dates etc. I told them that I\'ve made inquiries several time and VSC said that it be another 4-8 weeks but it had been many months since the 4-8 weeks (i.o I was making the point that I was not getting any real status report from VSC). Near the end I described the stress and depression that I experienced. It was a full page with Arial font 10. I wanted to make it short but it was quite impossible in order to get the point over. Have your letter proof-read by someone else and spell-checked.
2. I included a copy of the VSC processing times with the I-485 circled (you can get it from many lawyers\' sites).
3. I included a copy of my receipt notice.
4. I faxed the stuff to them since that\'s much much quicker and I can be sure that they actually got the letter. Then I crossed my fingers and hope for the best.

Obviously there are likely senators/congressman who are not nearly as helpful as the one I contacted. I\'m not claiming that it will definitely help in your case, but I\'m 100% convinced that it helped in my case. They told me to expect something from INS within 2 weeks and that\'s exactly what happened. If your case is really really old, then you really don\'t have anything to lose by contacting senator/congressman, I think.
