TN visa with waiver- getting advance parole?

I have a waiver to enter the US for B1/B2 visas, but it isn't annotated with "TN"

Now that I am applying for TN status, the border guards won't adjudicate it until I get a new waiver, which will take so long it will cost me the job offer.

If I can get the TN visa at the consulate, would it make sense to apply for advance parole to enter under "TN" status?
 
Canadian. Criminal conviction in 1998. Have had 5 waivers since 2001. At this point it's pretty much routine to get another waiver, it's just the job won't be open for as long as processing takes.

If things go well at the consulate I might be able to get an expedited waiver request (since my current one has > 3 years left, and I just need to add an annotation) but even then it might be a month.
 
Just spoke to my lawyer, he informed me that an advance parole is "status-less" and thus I would not be authorized to work under it.

Here's to hoping the consulate will grant me a replacement waiver + TN
 
It is unlikley that a consulate in canad a would grant TN. They almost always defer TN to CIS and CBP in such cases. You will find it difficukt to even get an appointment.
 
I got the consulate appointment no problem, I just went through the normal online application process.

The staff member reviewed the TN material, but refused to process it because of my inadmissibility. She told me the material looked fine for a TN approval otherwise. She told me she sent a waiver application request to the ARO. It's my understanding that if/when the ARO returns an approval, I will be called back to the consulate to have the visa put in my passport.
 
Be aware that even if your visa (which is really meaningless for Cdns) is approved, the CBP will be the one's deciding (in fact, re-adjudicating your TN). The state department can't override or supercede what CBP will decide.

You are corect to want to get the waiver done (you need this to enter US in any status, even tourist), but consular processing of your TN is pointless.

Get the waiver and head for the border, not consulate.
