Guys,

I am offered a job on a TN Visa in California and I have my online business in Canada, can I keep my business running in Canada and move and work in the US under the TN status,

-Can I register my business in the US while on TN status ?

-If my employer wanted to apply for H1 B visa or start the Green card process directly, will my business in Canada cause me issues?

The problem is not the business, it is that you cannot do anything for the business while in US.

This is true regardless of TN or H1 status.

Can I still work on my business in part time, hire employees, pay contractors without taking out any salary?

How long will the TN-H1 B- Green card period take? 4 years?

No. You cannot "work". It is not a question of salary.

4-6 years is a good estimate, assuming your employer is willing. You don't need h1-B.

Pretty hard to run a business while physically in canada while also working physically in US. Are you not understanding this concept?

Nelsona,

I understand that concept, but I am running an online business. So, may I run my business from Canada while I am in the US if I have the personal capability to do so? I believe I cannot register the business.

This is very important to me, because if I cannot I may decline the offer to move to California.

You cannot be physically in US to run your business regardless of where it is registered. It is illegal work. You are leaglly allowed to work only at your TN job.

You are NOT understanding the concept.

Ok, I don't understand your concept, so please explain it to me, why I am not allowed to own a Business any where in the world While I am on a TN status. Where does it say that ? What purpose I defeating if I do that??? Please give me some logic!

You are a guest in the US, allowed only to work on authorized status from US govt. By operating a business while in US without a visa that would allow this you are working illegally. That would seem pretty clear to me.

Nelsona,

Why would I need a US visa for a business that I am conducting in Canada??? If the business in the US, I agree with you and it makes sense. But if I have a business in Canada and I am working in the US for one employer under TN status, why do I need another visa for my Canadian business....

Because you are not "conducting business" in Canada. You are conducting business from your home in US. That would be "B" status work if you were a tourist an would be permitted.

You would NEED a B visa, but since you are in TN, and you can only have one or more TNs and not a mix of different statuses, you in reality cannot perform this personal work while in US.

You aren;t allowed to do anything in US without US permission, They are giving you permission to work in TN. Period.

Thank you Nelsona, now I get it!

What will happen if they knew that I am conducting my business from the US, will they revoke my TN visa? Can I go back and apply for one? Will they ban me from entering the US on any visa?

They will treat you like you are if you do this: an illegal alien. Barred for life.

Sell your business before leaving

I am not a resident in the US yet, so I am not illegal. Plus, do not you think selling my business will trigger that I am cutting my ties to Canada which could mean I am immigrating to the US and this will raise flags too and they may deny my TN visa entry or renewal!?!

There seems to be a lot you are missing in your understanding of the TN process. You do not require ties anywhere to enter on TN. Yo uare expected to have sold your hoese ect whe nyou move to US on TN, eben though it is temporary. It is not like B2 visitor entry.

Nelsona,

based on your answers, I have turned down the offer to move to California. Just to let you know, and I hope I will not regret it later in my life.
