Hi. I am under a Mexican TN Status and it expires in ten months. I have an approved I-140 and my PD is current. I can file my I-485 but I am worried that due to massive backlog I end up not receiving my EAD before my TN expires. I was thinking in waiting 4 months and extend my status via mail or extend my status by applying to a new visa in the consulate in Mexico. What is more recommended to do?

I would file immediately.

If you get new TN, especially with a consular visa, you will need to wait 2 more months before filing I-485. Who know what will happen?

There are ways to "extend" TN when it is about to expire, even with I-485 pending, by filing I-129 just before expiry. It will be denied, but the grace period will buy you more time for EAD if you need it.

Thank you for your response nelsona. How does this grace period work? During this grace period can I continue working?

A timely-filed non-frivolous I-129 allows one to work 240 days after expiry or until approved or denied.

Filed your I-485 yet? Git goin'.
