I am working for a consulting company in Canada they are trying to send a few of us in the US on TN Visa to work on a 1099
I was looking at the requirements and found out on one website that the company whose sponsoring you or handing you the TN letter should have presence in the US (should have a physical company). My consulting company have consultants and employees in the US on their payroll but does not have a physically company. They just work from their client's office.
In this case can they issue us a TN? Just to add they have around 30 employees and consultants around 90% of these are consultants from what i know all working on 1099
