TN visa renewal

Good morning everyone!!

Dear Immigration.com,

I have a little problem and I would like to hear from you, what is your recommendation to proceed.

I'm Mexican, I have granted a TN visa, right now I'm in US, my I-94 is going to expire the on Dec 16, I'm trying to renew my status for the first time, but I have 2 options:

1. Stay in US and Send the documents using premium service but premium is going to take 15 days to proccess this means I could stay in US with no status, looks like the premium proccessing time is about 15 day which is not bad but it is not enough for me. I still have a valid Business and Tourism B1/B2 visa I don't know if this could help to cover the gap of about 5 days.

2. Return to Mexico and re-do the paperwork to obtain a new tn visa + I-94 but this is going to be very expensive.

What option you think is the best option for me? and why?

If you stay in US, there is no need to use premium processing. Submitting the I-129 in a timely fashion (before Dec 16) gets you 240 day grace period, during which you can remain in US with TN-pending status. No need to spend money on premium processing. There is no gap if you submit the paperwork on time. Your B1/B2 visa is of no value.

If you leave US you will have to get a new TN visa stamp, but you would have to do that anyways, but you will not have to re-submit a TN (your new I-94 will be good) if you wait for approval.

Now I have some questions regarding the I-129 form,

Part 5 Question 5. Will the beneficiary work off-site? only have the options No or Yes.

In my work sometimes we have projects in other countries different than US, like southamerica, sometimes I have to visit to those clients, so at that time I work off-site but the majority of the time I'm in the office in US.
Do you know what is the purpose of this question?
What option should I check?


Part 5 Question 10. Dates of intended employment.
I'm not sure what date range should I ask, the first request made on the interview at the us embassy in Mexico City, was from about, march 8 2012 expiring march 8 2015. they gave me a TN visa of 1 year from december 16 2012 to dec 16 2013, but I entered to US and started to work on July 19 2013. I have about 5 months working, some options are:

1. Request the same date range that was stated on the original contract that I showed on the interview, from march 8 2012 to march 8 2015. But I read in a guide that it cannot be a date on the past.

2. Request the range of 3 years starting from the day I started to work July 19 2013 to July 19 2016. But It is still a date in the past.

3. Request starting from now to march 8 2015

4. Request starting from now to July 19 2016

5. Request 3 years starting from now

6. Request 1 year starting from now.


Again thank you very much for your help, I considered you guys the best guide on the net, I have been reading several sites and I saw you are the only one that have a lot of experience on this.

you are asking for an EXTENSION (this is the same employer, yes?), so the date would be from the expiry date of your TN, lasting 3 years from that date (assuming that this is how long the employer currently intends to keep you.

Off-site means in other US locations.
