TN visa questions

Hello all,

I am so glad I found this community today.
I have read some very informative postings and answers regarding TN visa here and I am greatly appreciated the members who shared the valuable information here.

I am Canadian citizen. I have been working on TN visa since 2006 with job title "Computer System Analyst" in the employer support letter. My real world job title is SAS Programmer/ Data Analyst. The 4 employers I have been worked for never have problem with being flexible about TN letter job title.
But the new company which I got a new job offer of "SAS Programmer" role is willing to use
"Computer System Analyst/SAS Programmer" as job title in the TN support letter and refused to remove "SAS Programmer" from the title even if I told them I may not able to get TN visa with this combination job title in TN support letter.

My question are:
1. Can I get TN visa with job title "Computer System Analyst/SAS Programmer"?

2. Can you help me if I am denied of getting TN? How much do you charge for helping me to get the TN visa?

3. I used to go to Vermont/Montreal POE to get a new TN visa or renew TN visa. I am in Boston. Some friends suggested me to fly back to Toronto and return to Boston and get the new TN visa at Logan airport. What is your suggestion?

4. I am working with Harvard right now and my current TN visa still good until April 2018. Does it affect my current TN visa if I am denied for the new TN visa?

5. The new job start date is Dec. 4, 2017. When is good timing to apply a new TN visa? Can I apply a new TN visa a month or three week in advance? I know one or two week ahead is reasonable.

1. In the past, when you presented your TN letter, did it not -- in addition to requesting a TN in CSA category -- outline your job duties, which would always have included SAS programmer functions? This should not be any different.

2. While this site is run and maintained by a lawyer, the posts here are from laymen, non-professionals having nothing to do with the site-owner. You would have to check wit him. Be aware that this firm is not considered a TN-specialist firm, but could probably help you.

3. I'm surprised in 11 years you've had TN, that you do not realize that people flying from Canada to US pass US customs and immigration in Canada. Thus flying from Toronto, Montreal, or most other Cdn airports will mean your TN will be decided at the Cdn airport, not at Logan. You would have to be coming from some other country to get a TN at Logan.

4. It should not. However, you have to make sure that you hold on to that current TN (I-94). You need to keep both the old and the new if you want to work at both places. One danger is though, is that they can say that since your new job doesn't qualify for TN, and your current job is essentially the same, then you could pull your current TN from you, too. Remember to NEVER, EVER quit or give notice to your current TN sponsor until you have your next TN in hand.

5. Now would be fine. next week would be better.

1. In the past, when I presented my TN letters with "Computer system analyst" job title, SAS Programmer functions were never mentioned.

2. I will try to contact the site lawyer to see if I can get help.

3. I never apply a TN visa at any airport before. Vermont/Montreal POE was the place I go to get TN visa. It is good to know how it works in the airport.

4. I will work for the new job if I can get the new TN visa. I should be careful to keep the current TN status until I get the new TN visa

5. I will try to go to next week Vermont/Montreal POE next week and keep you posted.

4. Typically, employees feel they owe their previous employer notice (they don't, but it is a courtesy). You can only do this if you keep your current TN (I-94) and the new one . so don't let the officer take it. Once you no longer need the old one, just file it in your records.

4. That is very good point. Thank you for reminding me about keeping my current TN visa and file it in my record when I no longer need it.
 
Hi Sue could you let us know if you ended Up getting the visa and which degrees do you have to qualify as a computer system analyst
