TN visa question, urgent!

Hello ,
I have an urgent question regarding applying for TN visa on Canadian border, here is my situation:
I am on H1B (expiry date in sept 2011), but lost job one year ago, I have been looking for job, but no luck till recently got offer from a company. my concern is that i didn't apply for H4(dependent on my wife's H1B) right after my job loss. am I overstaying in this case? what is my chance to get TN on border POE, what if they don't grant me TN at entry, can I get H4 (will bring my wife's H1B) at the entry? or I am denied to enter for ever? what is my option if this happen?

You were supposed to get H4 immediately. They will ask your history, and when you lost your H1 status. I don't advise lying.
In the unlikely event you are denied TN for overstay, then you will be denied entry. period.
You have a lawyer, so asking us at this point is pointless.

thanks for reply, I don't have a lawyer, I only had chance to ask one question to the lawyer, I can not afford a lawyer,
so any advice appreciated here. such as if I had to go to border to get TN, where POE is the best and by air or by land? from statistics on this board, by air seems have better chance. anyone had the similar situation?

can you explain "in a unlikely event you are denied TN for overstaying"? do you also suggest me to submit H4 right now, at the same time go to border to get TN? Appreciate any input.

Does the CBP office see when did I lose my job (H1B status) when he checks his computer?

Also I heard there is website to check if my previous employer has withdrawed my H1B after I left the company. have you heard this?

You are not allowed to submit an H4 by mail: you are not in legal status.
Whether or not he sees, he will ask. DO NOT LIE!!!!
 
Nelson, Thanks for prompt comments, I will definitely tell truth. I think it will really depends on the official now. I am thinking to go back to Canada, stay for some time, then come back to border for TN, will that make difference?
 
recommend good one please. but I do want to get more opinions from you guys , especially those who had similar experience.
