TN Visa Question? - Help/Opinion

Hi

I am going to applying for a TN Status in the next month or so justa waiting for my letter in the mail from the employer. I Am RN (registered nurse) my husband will eventually be joing me my concern is that i dont want him to be sitting around doing nothing for to long so my question is what would be the best route and quickest and safeiest way to get him authorization so he can work? Tn to GC? or Tn To Hb1? And would the process be alittle bit quicker seeing the fact that i am a RN? Your feedback and opinions will be greatly appreciated thank you
 
Well, H1-B for you does not get him any work authorization (h4 spouses have no more rights than TD spouses), and merely delays your GC process, which is the only way for him to get work authorization based on your status.
The quickest is for your employer to start GC process now, if they will, or find another employer who will quickly.
Yes the process is a little quicker for RN as I believe you get to skip one stage (the PERM stage), but it will still be a 1-2 year -- if not -- process before he would get work authorization.
The best would be for him to get his own work authorization. If he is not currently qualified for a TN or h1, then he would need to go to school while you work.
 
Ok well i was thinking to work a good periond of time(6mths) before asking to file a GC so i can pass probation and make sure i like where i am working first so pretty much after the 6mth periond get them to try file the i-140 or straight to the i-485 and as for him i dont think he will qualify for a tn or h1 hes a automotive service technician aka mechanic
 
Like I said, the earlier your start the GC process, the sooner he will get EAD. I'm thinking him getting schooled is the way to go, since nursing GC's don't grow on trees.

Just as an aside, RN's are not typically eligible for H1-B, not that it matters. APRN's usually are.

So, the typical flight path for a Cdn RN is to work in a series of short (6-12 month) TN jobs for a few years and then return to canada -- or marry a US citizen.
 
Sorry so nelsona if i am trying to get a EAD for myself and more for my husband does the i-140 need to be filed first? Or straight to the i-485??


Damn man this so confusing i couldn't imagine what school was like for these immigration lawyers
 
You would only get an EAD at the last stage before green card, first you must file I-140 (thesponsor files this, not you) , and at some point after that (you can't file both at same time right now) you and hubby will file I-485, at which point you will both have to file for EAD.
I'd say 12 months after I-140 at the current processing pace. Your biggest hurdle will be to (a) have your employer file I-140, and (b) stick with that job long enough to not have to restart the process somewhere else.
 
Does anybody no where exactly to go apply for the tn status @ the Toronto Pearson airport?? I wont be leave immediately but about 2-3 weeks so i can put my 2 weeks in @work

You cannot apply for TN at airport until you are flying out of Canada (to US). If you want TN "early" you need to drive to border.
 
ok so i finally got my letter of employment from the job that i will be working @ i was thinking of applying for my TN status on sunday? does it really matter what time or day i go?
 
also according to the hospital they didnt put a start date or time duration on the letter seeing that 1st i must hand over my previous doctor records and take my drug test etc. would this be a problem if i explain that to the cbp?
