TN visa extension

My husband has been working in US under TN visa for last 3 yrs. He runs a business (part time) and has employed 2 people. recently he tried to apply for a E2 visa(treaty Investor visa) which got denied due to lack of investment.
he has to go for TN renewal. He has a letter from the employer.
will the E2 rejection affect his TN renewal. what are the possiblilities and what sort of questions we can expect.
please guide us. Thanks for any help.
 
How is he "running a business" in US? This is not allowed without E2, and E2 cannot be got in conjunction with TN.


Surely you meant he is "proposing to run a business in US". Otherwise he is illegal.
 
we can register a business using our SSN. we cant work for our business, but we can have profits. Its bit confusing, but i know people who have registered the business with H1b status also. My husband works full time and he is doing his business also. he planned to do business as fulltime if he was granted E2. but since it got rejected, he has to continue with his job. he needs to extend his TN. any suggestions on this situation.
 
Sure, you can start a business, but you cannot run a business. That includes hiring, paying, managing, etc. He can only invest in the business, not make decisions. Registering a business is merely a formality and does not mean that DHS has sanctioned the work.

You said "He runs a business (part-time)" means that he is spending time running the business. This is illegal, regardless of how many temp workers do this.

He can get a TN renewal, but if his illegal involvement in his business is found out, he will be asked to leave.
