TN visa: engineer category denied

Hello,

I have an offer from canada however for temporary work (8+ months) i need to work in the USA and for this I need TN visa.

My degree: Bachelor of technology in software development
job title: software implementation manager (the position involves no programming, neither do i manage anyone as it's matrix organization)

 Develop, document, and revise test procedure and quality standards
 Identify, record, document thoroughly and track bugs
 Provide feedback to software developers and stakeholders regarding usability and
functionality
 Serve as a technical expert for project teams throughout the implementation and
maintenance of ERP and MHE systems
 Work on configuration, testing, integration with ERP and other MHE systems
 Responsible for integration mapping with ERP Systems and MHE Systems
 May direct and coordinate work of others to test system
 Investigate customer issues and report accurate conclusion in terms of product fix or
workaround to unblock customer's success
 Be the main point of contact for Customer during customer testing phases (UAT / CIT)

1st approach: show aspects of my degree related to engineer
  1. Your degree is akin to Software Engineering and we will show the aspects of the job that involve or are related to Software Engineering.
case rejected by: CBP officer by saying i don't have an engineering degree


1) Would it make sense to apply under CSA category?
2) we have written the employment letter such that it does not mention internal title.
however, i am not sure if it's a red-flag or not
3)how do you suggest i answer what changed since last time to CBP officer?
 
Let me guess. Your degree is a BTech degree from India, right? Then you need degree evaluation.
 
This is a CSA job and you have a CSA degree.
Why was engineering even thought about? Why not Medicine, while you are at it?

i have 3 questions which i seek your input on
a) CBP returned all my documents however do they keep copy from original petition?
b) now the goal is to file under CSA category. how do i explain what changed since last time to officer?
c) also, can you provide quick feedback on the description? and help raise red-flag

Not much help to the OP, but i think the "why" is as of about ~2-3 years ago, inexperienced TN lawyers got it in their heads to start pushing all IT jobs into the "Engineering" category and avoid the "CSA" category at all costs.

My suspicion is there's a virtual clubhouse where all these immigration hacks hang out and someone decided to distribute some kind of memo on the subject, and most of these fools don't turn on their brain to analyze which situations the advice would be appropriate for.

For my last TN, I got very testy with the lawyer when she kept pushing "engineering" category even after seeing my diploma + 6 previous TNs for an identical job which all got approved like clockwork as CSA.
