Hi,
I had my visa appointment yesterday at YUL Montreal Airport to apply for the TN status under the "Economist" category. I have an offer to work in the Investment Banking division (M&A) of an American Bulge Bracket (Top 3) as an Associate (6 years of experience). The petition was prepared and mailed to me by the external immigration council of my firm. It contained a Support Letter (the description of my duties was mentioning multiple times the term "economy"), a letter from the lawyers and a copy of my diploma (Bachelor and MSc)
After spending 3 hours at the POE, the immigration officer determined that I was not admissible for a TN visa under the "Economist" category.
I was therefore given the option to withdraw my application, which I did.
The main concerns were:
- Job Title in the Support Letter "Economist" didn't completely match the Job Offer (he asked to see it) and Internal title "Investment Banking Associate" and other small nuances
- The officer questioned the redundancy of the term "Economy" in the job description and said that the job description was closer to the definition of a "Market Analyst" vs. the one of an "Economist" (although I checked online and it's not the same salary, etc.)
- He also questioned my FINRA registration and asked why I needed them if I was working as an Economist (63 and 79)?? Not sure, why and what I should have answered to that
Previously, I was working for 5,5 years in New York, in IB in a European Bank under an E2 visa but the officer didn't question that. I am now questioning the quality of the petition I received. What should be the next steps going forward?
- Should the lawyers make some modifications to the Support Letter?
- Should I try to submit my petition through Premium processing?
- Is it ok to reapply at the same POE or should I try to cross the border by car?
- If the TN application is denied next time, what would be the consequences?
Any advice, prior experiences dealing with this issue would be very helpful!! Thank you
