TN Visa after a Job Loss

I was laid off on December 14 and started to look for a new job and got a new job. My joining date is Feb 21. My 60 days is ending on Feb 12, If the TN letter is delayed by few days will it be a problem when I go to border?

Do I need to travel out of country before that date and come back again after getting new TN?

It would be best if you left when your 60 days were up, but I doubt if the CBP would care if it were a few days over, especially that you would have left temporarily to get your TN, this ending any period of un-statused stay.

One final question:

Can i surrender my old TN and comeback into USA in visitor visa and after few days can i go back and get a new TN for my new employer?

Will it be a issue if I change to Visitor Visa?

Unless you have a home outside US, you are taking a big risk trying to enter as a visitor. You don't really qualify.

Stay put, get your TN application (a bulletproof one) and then head to the border.
 
When I left the US after 30 days (from day of termination) and reapplied for the new TN that was the first question I was asked.

Why did it take 30 days after the termination date to leave the US. I replied I had to pack up and settle my rental apartment and there was a 60 day window.
 
Our poster is going to be outside his 60 days, and won't have packed nor have a foreign residence. I would stay put for the few days it takes to get the TN paperwork.
 
Yes, but why do this if you have a job offer, which is the entire premise of your post? You would only do this if you are not finding a job. You file I-539 for B2, but must stay in US to keep the application viable.

I already received offer but the big brand lawyer office that my employer uses is delaying the issuance of TN Letter… they say it takes 2 weeks to issue the TN letter. My employer gave an offer 3 weeks back. By that time I will be over 60 days. So I am to traveling to Canada. They said they will courier the letter and then I will come to the border to get my new TN.
 
Your choice. I would simply stay in US the extra couple of weeks, especially if the new offer is in the same place you are living now.

Guess you can go visit relatives for a couple of weeks.

My 60 days grace period ends on feb 12. If I stay over 60 days, will it count as unlawful stay? Will it cause any issues when I go for my new TN at border? Thanks
 
I've already answered that question directly in my first response. Nothing has changed. Stress your urgency to your new employer to get you your TN letter. Besides, you would only accumulate illegal days if your I-94 was expired. Even then I would still wait for the letter and then go.

The letter you get may be crap, don't forget. You going to sit in a room for 3 more weeks after that? Stay home and comfortable, review what you get with them to make sure your petition is good (like I already said), and then go to the border.
