TN to H1B

Hello everyone,

I am on TN for last 7 years and recently applied GC and approved I-140.

I am now switching it to H1B, will I be able to utilize approved I-140 (from TN to GC process) for H1 cap exempt, apply for wife's H4 EAD?

The I-140 process is independent of your status. If you get H1-B it has no impact on your I-140 or GC process.

Once you have H1-B, your spouse can then apply for EAD. Of course, when you apply for I485, she can as well, and get EAD that way, too.
