TN to GC through marriage

Hi all,

I have been on a TN in the US since April 2020. I have concurrently had a spousal GC being processed through consular processing. I am in the final stages of my GC application with my immigrant interview at the consulate in early October. Can I work on my TN until my immigrant visa is activated (approx. 2 weeks after the interview when I get my passport back and activate it at a POE)? I assume once I have the GC, the employer needs to change my work status from TN? Thanks for information on this!

Yes. Once you return you can re-complete the I-9 as a permanent resident, with your passport with immigrant visa (which turned into I-551 upon entry) serving as a List A document.

Not sure you can enter an work on TN (actually, pretty sure you can't),. Besides, didn't you just say you don't get your passport back for a while? How are you going to enter US without it? Your I-551, when you cross will be your work authorization, and then your GC later.

Yes. I am talking about after the interview. He is in TN until he leaves for the interview, which will likely be in Montreal.
