TN to F1 / EAD Questions

Hi,

I am currently on a TN visa in an MBA program who is wanting to intern this coming summer in the US. Unfortunately most internships don't have categories under the TN and therefore I want to go to a F1 so I can get CPT. Wondering if I can go to the border and get this done quickly since the I539 seems like it'd take too long. Also, if anyone has advice I got married last year and have filed an I130 and will be filing my I485 package soon with my EAD and wondering if that would be faster to an EAD. I would like to have everything in hand by May/end of May.

Thank you for all the help!

You should first secure your next status (F1 can be obtained at the border), and then file I-485. Once you file I-485 you will not be eligible for any new status.

But be careful, marriage to a US citizen living in the US is almost automatically considered immigrant intent, and you risk denial of entry.

Why did you not file I-485 with your I-130 etc? It puts you at risk, as they now know you are married, but are no closer to EAD than the day you married.

I made an oversight and didn't file everything at once. So you are suggesting I get the F1 first and then get the I485 correct?
