TN to EB-2

Hi everyone,

I moved to US almost a year ago with TN status and recently realized that there is a way toward GC without going through H1B. I think I qualify for EB2 and my question is: do I need an employer to sponsor me?
I am a Canadian citizen and have a bachelor and a master in engineering from Canada. Also I am a member in two engineering boards and have 9 years of experience.

For EB-2 and EB-3 categories , you most certainly need an employer. The only exception being EB-1 or EB-2 (waiver) with extraordinary abilities in your chosen field. The other thing to consider is , unless you are a born Canadian citizen, that route is sort of not as straightforward as an H1B. Let us wait for some of the more experienced members of the forum to respond.

It is a bit confusing, in uscis.gov you quality if you have exceptional abilities or three of the following criterias:
1) Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
2)Letters documenting at least 10 years of full-time experience in your occupation
3)A license to practice your profession or certification for your profession or occupation
4)Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability
5)Membership in a professional association(s)
6)Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations
7)Other comparable ev

HBH...where were you born? That'll help with determining the best path forward
 
North Africa might very well work in your favor. But do check out the priority dates and talk to someone who has been on that path before, hopefully from your neck of the woods. Having said that, proving EB-1 is a daunting task, unless you have a Phd and have scores of publications and you are recognized fairly well among your academic peers. Good luck.

Thank you TnRaju. I just wanted to see options I have before talking to my employer for any sponsorship if needed and not sure if he will do that for me.
