TN/TD permit renewal by mail

  • TN expiring on 29 September 2008.
    Wife's TD (I-94) expiring on 8th Oct 2008.
    Wife's US visa already expired.

Questions:

  • Documents required?
    Do I have to send my passport along wit I-129?
    Is there an easy way for my wife to get her TD renewed without out of country?
    If I mail for her TD renewal along with mine then will she be out of status while her TD is in process?

Is there any thread with complete procedure for TN renewal by mail? I tried to search but could not find any.

question: How is it that your spouse's TD expres AFTER your TN? This is unusual.

In any event, as longg as you both file I-129/I-539 before Sept 29, you will both remain in status as long as you stay in S, until these are approved by mail.

It was unusual I think because when my wife got her TD and US visa I was with another company. Then when my wife landed in US then I had a TN with another company. We did not come to US together so may be thats why they gave her a 1 year I-94 from the day she landed in US.
Right now I am planning to go through the mailing process. My confusion is that my wife is not a Canadian citizen. She is from Pakistan. Can she still get her TD extended by mail?
 
As I said, you can both file by mail for extension. I-129 for you, I-539 for her. If you premium process yours it will cost $1000. There is no point to premium hers. You remain in status while these are pending, so long as you don't leave US. IF you leave before your I-129 is processed, you simply need to apply at the border. If she leaves however, and YOUR TN has not yet been renewed, she probably will not be able to come back in (unless hse is only travelling breifly within North America). So, YOUR TN is the crucial process. Her I-=539 simply doesn't matter much.

As long as she stays in US, she doen't need to get a new stamp. If she does leave however, she will need stamping before coming back, regardless of the status of her I-539.
You never send your passport to USCIS, send a copy only.
 
FYI,

You can't premium process I-539's. They'll just send it all back to you including the cheque. It happened to me last year.
