TN/TD extension - New DL laws for California

Me and my wife filed an extension for our TN/TD. We've gotten a recite from the USCIS, and lucky for me, my drivers license has a few more years to go, unlucky for my wife, hers was brought in under the new California laws.

By US law, we're legally allowed to be in the country now, and residents of California. By California law, we are considered illegal it seems for getting a drivers license. They won't issue a new license without the acceptance letter from the USCIS and/or I94.

Has anyone figured out how to get around this problem? This is just ludicrous. It basically eliminates any petition by mail, unless filed way in advance. Few people can work without being able to drive! It almost seems that they are enforcing their own immigration laws (living in California without the ability to drive is essentially impossible, like most states).
 
Same here in GA

I have a 10yr DL in GA, and recently went and took MSF. While @ DMV in GA, the DMV guy tells me I will lose my 10yr DL for a 9 month DL, since my i-94 expires in Aug.

I questioned his statement and he printed out a new GA law that requires all DL's for resident aliens to expire on the same date the i-94 expires. This new rule will make a lot of people who renew TN via mail to potentally be driving with "expired" DL's.

Apparently the "implicit" 240 days rule is not addressed in the GA DL rules, and therefore GA cops do not have to follow it. If pulled over, and DL is expired, it becomes a felony in GA, with a few days in jail while you "sort" out the mess. aarrghhhh!!!

No more TN mail renewals for me....
 
None of the states account for the 240 day grace.

So, the solution is either apply early enough thru I-129 (or premium I-129) or go to border before expiry.

This as been the case for 5 years in MN.
