Hi All

I have been working for Employer A on TN1 status for the last 8 years, however, received a new job offer from Employer B. I have asked the employer to issue me a TN support letter so that I can go to border and get the new TN. However, the new employer is insisting that they want to go through USCIS by filing an I-129 (TN Transfer)

There are couple options on the I-129 form

If they select New Employment or Change of employer - what would happen if the new petition is denied/rejected? - Will I be able to work for my previous employer with the old TN?

If they select Concurrent employment - I guess, if the new petition is rejected, I will still be able to work for my old employer with the old TN I have?

If someone can share any experience/thoughts in this, it will be highly appreciated.

Thanks

I believe that if 'New concurrent employment is selected' and the application is approved, the original TN with Employer A is good until it expires.
I'm unsure what happens if either of the other options you mentioned are selected and the application is denied.......I would like to think that your original TN remains valid but I'm not sure.......
