TN Status @ JFK

Hi guys,

I'm British/Canada and currently reside in the UK. My degrees and experiences were also obtained here in the UK. Can I get the TN status stamped @ JFK if I fly direct from the UK to NY, or fly to Canada and apply from one of the POE? Can I get the stamp place on my British passport whilst at the same time presenting my Canadian Certificate of Citizenship? Or is it best to get a Canadian passport for this purpose? I do not have any assets in Canada but have in the UK, can this serve prima facie non-intent?

Can someone be kind enough to email me a sample copy of their TN letter of employment? My field is in Accounting and Finance, and I'm hoping to complete the CPA soon. Also a certified accountant here in the UK.

There is nothing preventing you from getting TN at JFK. You do not have to go thru canada. The only caveat is that US airports handle only the occasional TN, so unfamiliarity breeds contempt in many cases.

As long as your degree is deemed equivalent to US bachelor's (foreign degrees often need to be evaluated as equivalent), it is acceptable for TN purposes. Your experience is irrelevant.

The I-94 and stamp can be held in your British passport (since a passport is not required for TN). I would not waste time getting a Cdn PP simply for this purpose. Proof of citizenship (preferably the card) is sufficient.

As long as you do not file an US immigrant petition (I-485) you will not be deemed to have immig intent; you do not need to have any assets outside US to 'prove' this.
