TN Status and Travel

Hi,

I am a Canadian Citizen working as an Accountant under the TN status. My TN expires in 2012.

I'm thinking of getting married in September 2010. My fiance is from India.

Can anyone please advise the pros/cons of following two options:

Option 1 - I travel to India for 2 weeks in September 2010 to get married. After marriage is registered, my to-be wife has to go to the US consulate to get her consular TD visa stamped. Do I also have to get a consular TN visa stamped in the consulate? What is the probabilty of having any issues at the POE while coming back to the US given strict checking nowadays.

Option 2 - My fiance and her family come to the US on visitor visa and we get married here. After the wedding, she can apply for TD visa while in the US. Would it be very difficult for an unmarried woman to get visitor visa from India to the US? Even after she gets the visitor visa, could there be potential issues in the POE for gaining entry to US?

1. You do not need or get a consular stamp. You are Cdn. They can be as strict as they want, you ahave a TN, and are working under it, and your wife will have a TD visa from the consulate. You do not have to be there.
2. If you were a US citizen or GC, this method might be fraudulent. However marrying a TN is not immig intent, and should not hamper entry on B2 (in fact she could enter on B2 even if marriied to you, so long as she has residence outside). I don't see a problem either way. She would probbaly wish to get a TD visa next time she leaves US.

So it comes down to where you wish to marry.
