tn renewal

I am planning on traveling back to Canada over the Xmas holidays. At this point I am not holding out much hope of having my tn renewal (notice date of July 6). It is my understanding that when I leave the country I abandon my current renewal application. I have no problem re-applying at the border when I return to the US but, is my work status affected during the time I am in Canada? If it is, am I better off applying for advanced parole and waiting out my tn mail in renewal?

Thanks

has your existing TN expired? if yes, then leaving the US before your mail-in renewal is approved would be considered abandonment of the petition. Then you would just have to apply for a new TN at the border when you re-entered.
The impact on your work status while you are in Canada is that you are not legal entitled to work in the US because you will not have a valid work visa. I don't see this as a problem because you will not be in the US anyway.

You mentioned Advanced Parole. Have you applied for a greencard? That is the only reason you would need, or couuld apply for, advance parole.

If you're eligible for an advance parole, you're not eligible for a TN renewal.

Do you have a pending I-485?

Thanks...yes my current tn has expired. My concern about my status while I am in Canada is because I will still be getting paid (vacation pay). I just don't want to jeopardize anything in the future.

I have not applied for a green card, I didn't realize advanced parole was only for people in the green card process.

When you are in Canada you have no status, and are not under the jurisdiction of the US government. You can do whatever you want and get paid.
