TN Renewal Question

I am canadain citizen and my TN renewal coming close, current I-94 is valid until Jan. 12, 2009. I have to travel to Europe between Nov. 30 to Dec. 20.

My Question is when should I file for extension. Can I apply after I come back and mail application for me and my family together on Dec. 22? or Should I apply before I leave?

I don't want to apply for extension at the airport becasue then I will have to apply for family extension seprately and it takes for ever. Last time it tooks 9-10 months to get TD for them.

You can apply as late as jan12th, so, if you don't want to get TN at the POE when returning (it would be close enough to expiry that you would get it), then wait until you get back.

There is no guarantee that if you submit your I-129 with their I-539, that their's will be processed any faster, but it is possible.

Of course, it really doesn't matter how long the TDs take, now does it. The filing keeps them in status, and getting the I-94 for them is of little value.

My HR Manager is saying that we should file for extension before I go abroad. I can still come back on my current TN because it will be valid at the time of my return.

Is it true? can I travel while my application is in process?

Your I-129 is not affected by your travel, since it is the company's petition.

Any I-539 however, since it is self-petitioned, would be jeopardized by such travel, especially if outside N America.
