TN Extension via USCIS vs i9 Employment verification

Hi All,

My company is applying for my TN Extension via USCIS using Premium processing. It should take around 15 working days assuming I don't get any RFE.

My current i9 Employment Authorization is ending on 27-January-2024 (same day as my current TN). They have contacted me for reverification of my employment authorization.

If my new TN extension takes beyond 3 weeks (i.e beyond 27-Jan-2024), is it ok ?

Yes. Your pending I-129 keeps you in legal status. Your firm can use that in the meantime. Sounds like your HR department and legal department aren;t talking together.

You are authorized to work for 240 days while a worker status extension of stay is pending, as provided in 8 CFR 274a.12(b)(20). The Handbook for Employers section on Extensions of Stay tells the employer how to handle the I-9 for employees during this 240-day extension.
