TN Extension experience

Hi All,

I have been with my current company for the past 3 years and my TN is getting over next month. I was preferring to go to a POE and get a new TN. However my company is not willing to do it and insisting on processing TN extension with USCIS. They have also mentioned that I cannot leave US till the time it gets approved

1) Average how much time does it take to process TN extension with USCIS ?

2) What documents is required from the Attorney (Is it the same as what I submit for TN).

3) I have been working remotely in Canada also due to Covid issues etc.. Would this cause a issue ?

4) Once TN extension gets approved, do I need to go back to POE to get it stamped again ?

Appreciate if anyone can tell their experience also

Since you are dealing with a lawyer, I will let them earn their fee to put together your package.

If you work remotely from canada, how are they asking you to remain in US?

You can find times online for I-129. You should use premium processing, which will take two weeks. Otherwise.....

You do not have to remain in US while I-129 is being processed, but if you leave you should consider simply doing a border petition when you return, proving that the I-129 was a waste of time and money.

If the I-129 is approved with a I-94 attached, you do not have to do anything, except stick the new i-94 in your passport (your employer will have taken a copy for their files).
 
Nelsona, Thanks for the update.

I meant I work both in Canada (Remotely) and in US..but I am a US employee. Hence I have been asked to be in US till the time the processing takes place.

What documents are required for TN extension...is it the same list of documents required to go to a POE ?
 
So, it would seem unreasonable to ask you stay in US -- and you don't have to.

As I said, let your lawyers figure out what they think you need. You got TN before at the border, and I suspect you will again,
