TN Denied

Hi,

Just need some advice.
I had my TN application denied as "System Analyst"
I had obtained TN before successfully under CSA. This is a new company i am applying for.
I have WES credetials evaluated and 4years Bachelors in IT. Qualification wasnt the reason.

The reason the officer gave me was that Job description had more then what a CSA does. He was focused on just one line below.

1. Overseeing End to end installations for infrastructure projects. ( IT Manager Job)

He just didnt liked the word "oversee"

The officer said this a IT Manager job description.

What can i do in this situations. The company who hired me really want me there ASAP.
They wanted me there before January but i couldnt get the appointment and now this.
Is there any way the company can help me.

HELP!!

Hi Nelsona,

You mean to say that i should ask my company to send me another Offer letter with that line removed.
Will they accept the new letter from the same company.

Also when i check it on bls.gov wesite, it state that its a job duty, but the officer didnt wanted to listen. He said he know better as he does this everyday.
I hope i had this duties print out with me. or should i try at another port of entry with this print out in hand to show them.

Thank you for your reply.

Do NOT use another port of entry. This called port-shopping and will get you barred. The simplest is to fix the letter and go back. The job description in the TN letter is not supposed to be a cut-and-paste from, OOH, so having something that is word-for-word out of OOH already raises suspicion.

Your time to argue is past. You should have done this at the time, not go back now with an "I told you so".

Have company describe what you will do -- in their own words -- without the words oversee or manage.

Hi Nelsona,

Thank you for your reply.
I have asked the company for the fixed letter.
My question now is can i go to another port of entry with the new letter.
As before i was going to drive but now i have to fly as they need me there asap.
Will that be an issue.

Now that you have changed the letter, you may go to any port; bring any note that the original officer may have given you for the reason for your denial.
