TN - Change of Employer

Hello,

I am currently on a TN working for an employer in WA State. This TN was originally issued for 3 years, and now has 2 years left till its expiration date.

Just recently, I got a new job offer from an employer in California. They mentioned they were going to file a new I-539 form or something like that. I was just wondering, when they file this form - will this give me a new TN with a new expiration date of 3 years or will it only change the Employer and I will keep my current expiration date?

Lastly, will I have to go to a border or poe to get my new TN issued or will all of this be done electronically through USCIS? For my original TN, my current employer filed a TN online for me, after which i took the i797 form to the border where they issued a TN to me (meaning I still had to go the border to get my TN issued.) Will the same be the case this time?

It is an I-129, and it must state new concurrent employment. You will then have 2 TNs. Nothing will change for the first one, the new one will have a 3-yr validity if that is what the sponsor asks for. You can then choose when to leave job 1.


If they file an I-129, that avoids border, since you are already in a legal US status (you weren't when you first got TN).
