TN and Secondment to US Co

Hi, I am a Canadian, self incorporated, and work as an independent contractor for a US company on TN status (mathematician/actuary category).

I am investigating whether I could be seconded to the US company from my company instead of acting a an independent contractor. I read an account of an individual who was turned away by CBP as their Employment Contract or Sponsor Letter of Employment (wasn't clear which) did not have the correct compensation arrangement. The CBP officer said the US Co should be paying the compensation.

Appreciate any advice.
 
You can easily change to employee status with a new TN with OF COURSE the correct compensation arrangement mentioned. In fact, since your sponsor and job have not changed, if your method of remuneration was not specified in your original TN application, you could simply switch now without any change in your TN.
