TN and E visa processing for two different jobs

Hello,

I have a dilemma. I am on a J1 visa that expires at end of March at my current job and they want to start a visa process to the E2 visa. However, I have a job offer letter pending from a US Company in DC, for which I would get a TN Visa. Is there a problem if there are two visas in process for two different companies? Moreover, since the TN is uncertain whether I can actually get it, simply quitting and giving up the E2 Visa process might put me out in the cold if the TN does not go through. Anyone have recommendations? I am really stuck between a rock and a hard place here. If both processes are possible, I am in the clear.

thanks,
Igo

are you sure it is an E2 visa that you are applying for? E2 is an investor visa

Eligibility Requirements: The applicant is required to come to the United States to develop and manage the operations of an enterprise in which the applicant has invested or is actively in the process of investing a substantial amount of capital. In addition to the investment in a business enterprise, the investor must be coming to the United States to develop and direct the operations of the enterprise in which he or she has made the investment. The applicant must have more than fifty (50%) percent ownership of the investment, unless the applicant is coming as an employee of the enterprise

Anyways, you can apply for both E2 and TN at the same time. it is not a problem. what is a problem is which of the two applications is approved last, because that is the status you will then hold.

definitely E Visa... thanks for response

Hello,

Thanks for the response. Definitely processing the E Visa investor visa for my current job, just confirmed with lawyer. As long as I don't have a problem processing both of them at the same time, I don't have an issue. As soon as I have my TN Visa in hand, I will quit my current job and either stop the E visa process or cancel it, depending on which one I can get first. Thanks again for the response.

sincerely,
Igo
